arrears

What is the name of your state? VT...ok..my hubby and I are at each others throats over this. I pay child support on time, but, do have arrears from being out of work due to illness. Those arrears are being paid by extra money taken out on top of my court ordered child support. Here is the problem. I do not have a checking account. I want one. We have 3000.00 saved to put into a savings account so far to get us a home. My hubby says if I open a checking account or savings it will be taken since I have arrears. My argument is I have been paying on the arrears and my child support for the last year and a half on time, never missed, and the arrears is going down. The court order is showing what is being taken out and why. Since there is a court order it is a legal agreement of payments and the state won't freeze my account and take the money without another court order since I am never late paying. So, if my hubby is right does this mean I can never have an account until the arrears are at 0? I owe about 5000.00, down from 7500.00. It got high due to my surgery and out of work for almost 8 months. Thanks Faith

I'm answering this even though I answered on your other thread, because someone else might see this:

Although you have a court order for payment of arrears, it does NOT prevent the state from freezing any bank account, or taking any other action to collect the arrears.
