Divorce in TN

She really needs to see an attorney. Right after having her head examined.
...and her tubes tied. :) I know an attorney would make life so much easier, but she just can't afford it. All of the paperwork is finished, she's ready to file...but now we have this setback. I noticed a section of the complaint for divorce form that asks if wife is pregnant or not, so obviously the judge will bring it up. If her husband decides to contest paternity, will it hold up the divorce proceedings?

some states won't allow you to get divorced if you are pregnant until after the baby is born. also you mentioned she has 2 kids now, with her husband? then the waiting period is 90 days after filing the divorce papers, she may be showing by then.

Like it or not, her situation is complex enough that she needs to find the money to get an attorney or find one through legal aid or something. She's making enough of a mess of her life without making one more major mistake.

No, actually, the other two kids are by two different fathers, neither of which are her husband. :rolleyes: Hence the reason she needs her tubes tied.

Legal aid only handles domestic abuse divorce cases. Thanks for your help, I'll pass the info on to her.

And just to let ya'll know, I neither approve of nor condone my SIL's behavior thus far. I'm just trying to help her get her life back on track for her children's sake.

i dont know, i was pointing it out with the hopes that someone else would come along who did know!

she is your sil? is the man she is divorcing your brother or are you married to her brother? just curious.

You will not get a divorce in Tennessee if she is pregnant. Yes it is going to hold it up. Husband will have to fight paternity or he will find himself paying support on a child that is not his.

I was afraid of that. What would you suggest now...should she wait and file for divorce after the baby is born? Go ahead with the divorce now? Just trying to figure out what to expect.

She can file and get the paperwork all started but from my experience here no judge is going to grant it until after the baby is born and paternity is established.
