I am not sure how a change in venue would penalize him, what do you mean?
You don't want to have to travel to AZ for the future court hearings. However, it was YOUR choice to move. Why should he be penalized by being forced to travel to OH just because YOU chose to move?

(That's what I mean)

Because I've been penalized for having to be reminded I slept with this guy... Ok, that was not a serious reply

I see, but I still think thats stretching it a bit on why I am a bad person for trying to move the venue, he didn't even show last time in AZ after I flew 2000 miles for court, so either state, I think he'll be a no show :)

Have a great weekend... getting out of work and taking the daughter fishing!

All things considered, life is good and thank you for trying to help, although you still didn't answer my question... if I wanted to pursue it, would I just file the "change of venue" forms and wait for a response, or do I get a court date scheduled or what?

I never said you were a bad person...I'm just explaining my answers to you.

I would suggest you pay for a consultation with a local attorney...

I SHOULD HAVE KEPT READING AS THIS WAS ALREADY ANSWERED>

So anytime you want to go back to court he would have to fly to Ohio where YOU MOVED and you don't think that would penalize him? Under the UCCJEA AZ has jurisdiction and will continue to.

And anyway, if I dont stand a chance of moving it, I guess its all moot anyway, or are you trying to get a rise out of me
But, anyway since I'm long winded today and fell like whining (if you cant read through this, please anwer the above question) - he agreed to the move then changed his mind one day before, which pissed off the Judge. He never responded to the court dates, or the parenting plan options I submitted, nor did he take the required class, drug tests ect.

So?

Maybe the fact he chose meth over his kid, chose meth over financially supporting her, maybe because I have tried to be supportive despite his issues, so my daughter would have her dad around, regardless of his stupidity. Even after I had to get an order of protection against him, I still tried to find a solution so he could see my daughter (which, he didnt take advantage of, he never made the effort to go to HIS moms to see her).

His daughter as well.
I have supported all of her financial and emotional needs for the last 11 +years and don't ffel like getting screwed anymore because he had a lucid moment.
The Judge did not decide it was in my childs best interest to keep her in AZ, he did decide it WAS is her best interest to stay in OH, with me and also in her best interest to not have any contact with her dad...
So? Dad still lives in AZ which has jurisdiction over the case.

hmmmm why should he be penalized, to have to pay something or be responsible, thats being penalized?????
You want to punish him basically for you moving to Ohio. If you want to pursue contempt you do it in AZ.

Maybe he needs to start being a daddy sometime!
Still not sure how this penalizes him though?!
And you may never understand.

Then you should get rid of your daughter because that is the most serious reminder of having slept with him.

Depends on the county. Some would hold a hearing, some wouldn't But you wont' win. You would waste money.

HAHA You are funny!

Gee, I think I said that wasn't a serious reply, and I also seriously doubt you would know if I'd "win". No one knows, and I wasn't asking if I would, I was asking HOW to file, to which none of you really answered.

Thanks anyway!

Well, I did contact my attorney in AZ (I didn't want to pay another retainer)
But his view is much different than all of yours, I guess thats why he charges (you get what you pay for) and he knows the case better.

I guess sometimes you just have to suck it up and pay the person who know best :)

Thanks guys for spending time typing all of your opinions, I know I did ask for them, whether I agreed or not

Ask your paid for attorney how the UCCJEA applies to your case. And then ask him how he knows what OHIO courts would do based on the fact that he is licensed to practice in AZ and NOT Ohio.

Wow, so a paid attorney (and prominent family law attorney) is an idiot? Because he has a different perspective than someone dishing out free opinions on a message board? I think I'll go with the attorney. Not sure how anyone knows exactly what a judge would do, but hey, you must be super special.
And why such a judgment from someone who does not even know the details of my conversation with him... hmmmmm interesting. So what did he tell me exactly? Judging and answering without the information and facts??? Shame on you :D
Now I know that I was correct, but thanks anyway for continuing this thread although I think it was finished... asked and partially answered :D
