So i bought a Condo last year. now the owners upstairs have a leak in their pipes which rot away at my ceiling in the bathroom. i got a plumber to come look at it and it is defiantley coming from their unit...they are refusing to fix my roof...
can anyone tell me if i have a case or not?:confused:

You do have a case. you can simply tell them that you think they are repsonsible, and if they don't give you their insurance info, take them to court.

Can the OP have their insurance company get the info on the at fault neighbor? would that get recorded as a claim on his own policy?

Yes, the easiest thing for OP to do, in order to mitigate the damages, is to file a claim with his home insurance company, pay his deductible, and wait for his insurance company to reimburse his deductible when it is received from the at-fault party or his insurance company. Yes, it is recorded as a claim since that's exaclty what it is, but it is not an at-fault claim.
