CP Visiation for pick ups and drop offs

What is the name of your state? Tx

My husband has custody of his daughter (9) and her mother gets her EOW , Thursday for dinner, alternating holidays , and 30 days in July. I guess it is the standard visitation is Texas?

This is what the CO states exactly with pick ups and drop offs:

Summer Weekend Possession by CP : If CP gives NCP written notice by 4-15, CP shall have possession of child on any one weekend beginning at 6 PM on Friday and ending 6PM on the following Sunday during any one period during the extended summer possession by NCP in that year. Provided that CP picks up the child from NCP and returns the child to that same place.

Surrender of child by CP: CP is ordered to surrender the child to NCP at the beginning of each period of NCP possession at the residence of CP

Surrender child by NCP: NCP is ordered to surrender the child to CP if the child is in NCP possession or subject to NCP control, at the beginning of each period of CP exclusive periods of possession, at the place designated in the standard possession order

That is all that is said about pick ups and drop offs. Where does the CP pick up the child on the extended summer possession? Can she choose anywhere? Can CP go 3 hours away and we have to pick her up there by 6PM on a work day to return her two days later to the same spot?

That's how it sounds to me, and I would imagine it was written that way so that NCP doesn't have to trek back and forth from a planned vacation so that CP can have child for a weekend during the vacation.

Extended Summer Possession by CP: If CP gives NCP written notice by 4-15 of a year or gives NCP 14 days written notice on or after 4-16 of a year CP may designate one weekend beginning no earlier than the day after the child is dismissed from school for summer vacation and ending no later than seven days before school resumes from summer vacation, during which a otherwise scheduled weekend period of possession by NCP shall not take place in that year, provided that the weekend so designated does not interfere with NCP period or periods of Extended summer possession.

So if my husband is reading this right this is that it says: CP can choose any weekend during the extended summer visit in July (NCP always takes her 30 days in july) that he wants his child. He can also choose any one weekend of the NCPs weekend during the summer as long as it is not in july (extended summer visit) since he already gets her any one weekend that month , or mothers day (of corse)?

Summer Weekend Possession: Yes, he could come get Kiddo from Mom wherever she may be for one weekend in July. But he is really pushing the due date of 14 days prior, deciding before 4/15/08 would have been better.

Extended Summer Possession: This part of the decree states the Dad can “take" one of Mom’s weekends during the summer (NOT the during her July extended visitation) so that he can have an extended vacation of his own.

I don’t know the circumstances but I must say, this kind of sucks for Mom.

Dad can interrupt her summer possession but Dad is insured gets uninterrupted time?

How about the 12 days between Mom’s EOW that he gets year round?

NCP gets uninterrupted time during July also. CP gets one weekend out of July, so NCP may get 2-3 weeks uninterrupted. It allows for a vacation longer than a week, if wanted by both parties.

Also, he doesn't get her for 12 days uninterrupted year round between EOW. NCP gets Thursday for dinner (which isn't much, but still would "interrupt" CP's time).
True, true true; however, the flavor of ALL of OP's threads is 'how can we legally screw mom.' I understand that mom hasn't lived up to her obligations regarding child support. I understand that there were acrimonious feelings with the divorce. But dad got custody, and instead of being the bigger person and fostering the mother-child relationship for the child's sake, he seems to be trying to screw with it every chance he gets.

At least, that's how it sounds to me.

Ahh. I gotcha. Didn't realize that they are always trying to screw mom legally.
 
WOW. Dad has never tried to "screw mom legally" if anything he has tried to get mom to see child more even on his time for the last 7 years. She chooses not to. So I dont see how that is dad trying to screw mom. All he wants is to see his child for two days. But we have always picked up from the same spot for the past 7 years. Mother is mad at dad and is wanting to make dad drive 4 hours to pick up child and it is not her residence.

Dad is whining because he "wants to see his child for 2 days" when Mum's time with her is what you state..?? Get OVER IT!!!

This is true, however, this also has a time line. Mom has to identify the weekend before June 1. No notice and you loose it.
 
mom choose visitation the way it is with her actions. Which is not what this post is about. My husband has a notarized letter by mom stating what weekend in July he gets his CO visitation up until the child is 18. And that is all the question was about ...where to pick up. But thanks, I already have a lawyer working on it
