My soon to be x and I filed our 2007 tax return jointly (advice from father in law who happens to be a CPA) even though we have lived apart for 2 years. My stbx owes the irs 941 tax money for a business that he lost so our return went to IRS. The business was his, my name is not involved with it at all (he has since lost the business and filed for bankruptcy.) I just looked on line about the stipend return we are supposed to recieve and it says that if any tax is due that the amount may be reduced or not given at all. Long story for my question! Should I amend the return and file as single to recieve the stipend?What is the name of your state?

You may not amend a return from joint to separate. Your father-in-law likely can be santioned for conflict of interest unless he advised you of the consequences of filing a joint return with his son.
