My Lease agreement expired on April 7th of 2008 I did not renew my lease agreement. I advise my landlord on the 4th day of June 2008 that I would be out of the apt on the 1st of July, rent is paid in full for June. On the 24th day of June I received a letter from my landlord denying me my security deposit back because I failed to give proper notice that I was vacating the premises. The letter stated that I must give a 30 day notice upon terminating the lease agreement. I am a month to month agreement. How can I get my deposit??

Month to month rental agreements typically require a 30 day notice that one is leaving. You did not give notice 30 days in advance. Therefore, your landlord is using your security deposit to cover the rent you would owe for July.

You are renting by the month, not by the week. By giving notice on June 4th, you in essence told them you would be renting through July. Unless your state allows proration
of the final month rent (like California), you owe for the entire month of July.

BTW - I don't get your dates. Are you still living there? When did you do your walk-through? Pay July's rent and the LL would consider giving your your secuirty deposit back. Security deposit is not for paying the finals months rent, it's to cover "damages".
