No not homework. No just seeing if yall all agree on one thing. Besides its a general custody question and this is the forum for it right? I am trying to get facts not opinions yet. I mean its great information wise but im really needing facts from anyone with the knowledge or experience in Texas. Thanks.

I dont have a case. I just need or would like answers. You get alot of, this is true and that is true, so I figured one simple question. :) . Like I said I dont have case just need some experienced legal advice. You may choose not to answer if you know or not but someone with legal experience in Texas or knowledge of the Texas family court system would be very helpful. thanks again :)

All of those are legal and parenting choices. The top answer -- only one really -- for a change of custody -- a SUBSTANTIAL CHANGE IN CIRCUMSTANCE.
 
NO. Persistent means "been happening for a while."

Change in Circumstance means something has CHANGED.
Well I mean persistent as in, not just going out one night and doing drugs, but being an addict.

I'm confused, if it's not considered a change in circumstance, then what is it considered when a judge orders a change of custody because of it?

We are being asked to answer questions in a vacumn, and the law doesn't work that way. Drug addiction that can be proven with hard evidence is of course a significant factor in a custody case.
