We are being asked to answer questions in a vacumn, and the law doesn't work that way. Drug addiction that can be proven with hard evidence is of course a significant factor in a custody case.
Actually drug abuse is a significant factor. Not necessarily the ADDICTION portion.

Well I mean persistent as in, not just going out one night and doing drugs, but being an addict.

I'm confused, if it's not considered a change in circumstance, then what is it considered when a judge orders a change of custody because of it?

I read that in Texas refusal of visitation (lets just say 356 hours) can be a major factor? Im seeing if this is a reason? Or Not?

Then you need to give SPECIFICS.

In order to change custody in almost every state, one has to prove that there has been a substantial change in the circumstances of the CUSTODIAN and/or the CHILD/REN. THEN one has to prove that the best interests of the children will be best served by changing custody.

Google 'Best interest factors + texas + child custody'.

The law is very broad therfore you never know what it might suck in & spit out. :)
