I have been working for the Alliance for Disabled in Action for approximately 5 years. I interview people for New Jersey Transit Access Link at the Alliance for Disabled in Action which is a nonprofit agency. I am a C4-5 quadriplegic and utilize voice recognition to conduct the interviews. I was released from work due to necessary construction and remodeling of my office area. The interviews need to be conducted in a private area. I had my own office when we were located in the basement but now we moved upstairs where a majority of the employee’s offices are arranged in a cubicle fashion. New Jersey Transit comes periodically to modify and monitor employee performance and noticed the privacy was gone because other people can hear the interview while it's in process. The information is supposed to remain confidential between the interviewer and the interviewee.

On April 28, 2008 someone from New Jersey Transit was present during an interview and noticed that other people can hear information that is supposed to be private and they postponed interviews at the Alliance for Disabled in Action. I filed for unemployment online and spoke to someone from unemployment at the Perth Amboy office. I had a telephone interview with someone on June 4, 2008. She had my earnings broken down and told me to expect a call on June 9, 2008. The following day I received two letters from unemployment (see enclosed). I never received a phone call on June 9, 2008. I called unemployment again and they told me my claim was invalid. She told me I did not qualify for unemployment benefits based on the information she obtained from my W-2 form.

I received a phone call on June 25, 2008 from the Technical Support Group and the gentleman said you need to earn $143.00 weekly or $7,200 a year. He said you have a right to appeal.


I spoke with Bob Gillespie Assistant Deputy to the Director of the Office of the Commissioner for the Board of Labor on June 25, 2008. Mr. Gillespie told me the same guidelines for unemployment. He said you have two appeals but they use those guidelines to justify the amount of unemployment you receive.

Mr. Gillespie said if you do not qualify for unemployment insurance the money that all the people make goes into a "General Fund". He also mentioned that other monetary amounts from different sources go into this "General Fund". A lot of Constituents pay into this fund and they are not even aware that it exists. Since the "General Fund" fueled by people like myself I should be able to have access to what I have contributed to this fund.

I am disabled and willing to work part-time. There are many individuals in the state who are on assistance from the government who are not willing to work. My question is "since I paid unemployment insurance why can't I have access to why you're entitled to as an employee"? Can you justify this explanation?

I am on Social Security Disability Insurance and need to work for supplement money for food, shelter and other necessities

Each State has regulations that specify what the required minimum numbers of hours worked and wages earned must be in the 12 months/4 quarters prior to a UC claim being fired in order to qualify for benefits. If you don't meet the criteria dictated by your State's UC laws, then I'm afraid that's that. The UC Division adminsters your State's unemployment regulations - they don't determine what the requirements areand they don't have the authority to ignore the statutes.

Can you justify this explanation? No, as I'm not a member of your State legislature.

Um, excuse me, but no one here has to "justify" the answer or the decision since we're not the ones who made it.

The right to unemployment is not absolute. Unemployment is available IF the qualifying criteria are met. If you did not meet the criteria, you do not collect. End of story.

Larry - did you earn less than $7200 last year on your W2? was that information accurate?

For weeks worked in 2006, the amount needed to establish a base week is $123; for weeks worked in 2007, the amount is $143; and for weeks worked in 2008, the amount is $143. These wages must have been earned during a 52 week period that is called a base year. If your earnings during your regular base year period do not meet the qualifications for a claim, earnings in other base year periods will be reviewed. You may qualify for benefits if you worked at least 20 base weeks (a base week in 2006 is minimum weekly earnings of $123; a base week in 2007 is minimum weekly earnings of $143; and a base week in 2008 is minimum weekly earnings of $143), or a total of $7,200 in any one-year period in the last 1 1/2 years for a claim dated in calendar year 2008. Yes they made less than $7,200. I'm a little confused on the material they sent me. They sent me two unemployment insurance statements. The first one stated I was eligible for $161.00 per week. The other stated $0.00. At first the lady on the phone stated I was eligible for $161.00 per week then I received the one for $0.00. They calculated a dollar amount and then they send me nothing!
