What is the name of your state (only U.S. law)? IL

Hi,

I sold about $400 products to a customer from my website. I ship the products before the check cleared. The check bounced. I send her email but no response. The phone# she provided 'is not a working number'.

What can I do? Can I file a compain with her local police office or something?

you can file a complaint, but even if yuo walk away with nothing, let thei be a lesson learned; always wait for checks to clear before sending merchandise.

Many online companies will hold your order for 14 days after they receive your check to make sure there are sufficient funds. You should do this too if you are selling online.

If it was through ebay, you can file an unpaid item strike and file a complaint with ebay but it may be unlikely that you will see anything if this was a "new" account and was run as a hit and run type thing.

Yes you can and you can also have her arrested for writing a bad check. Of course you will probably have to go to her state and do it.

Not very likely. Most states have a much higher limit before a bad check is considered a criminal matter. In my state it's $15,000 for a single check. Anything less is strictly a civil matter.

Which they will still issue a warrant on. Only thing is they will probably just have to go down to police station, turn themselves in, get printed and then released with a court date.

I have seen people have to turn themselves in for a 10 dollar check here. Interestingly a post dated check does not normally fall under the bad check laws of any state.

Civil Penalties
Illinois. Treble amount of check but not less than $100 nor more than $500 plus attorney's fees and court costs.

Criminal Penalties
Illinois. Up to $500 fine or up to one year in jail, or both.
