Banned wrongfully and unable to access purchased Items

What is the name of your state (only U.S. law)? FL

So I was a member and moderator on an avatar based web forum. I was wronfully banned and had spent over one thousand dollars on items that I could only use on the site. These Items are equipable to your avatar and are virtual, but I paid real money for them and can no longer access them. I have filed complaints with several agencies and would like to know what the website has to give me if anything legally. I contacted the websites owner via hotmail and they replied to me via msn. The owner told me he would give me the money I spent back but not my account. By the end of our conversation he went back on this and changed his mind telling me to continue filing my case which I have continued to do. I would like to know what actions I can take besides filing with the BBB and a few other agencies. Also I would like to know if these agencies can take any action to either get me my money or my account back.

The BBB and these other "agencies" do not have the legal authority to force anyone to give a refund.

Those where the only terms of service on the site. I can no longer log in even from a new account to see if they have updated things. From what I remember they did not have terms on the items. They never specified that they belonged to the site and not me...

Edit-Oh, and they thought I off site traded items... which I never did. Which means either trade there items for other site items or sell them to someone for real money. I tried explaining that I had not to the owner but he would not even look at my evidence.
