Daughter Pictures on Internet

Hello.. I am not sure if I am asking this question in the right place.. But I have a problem with my Sister In Law posting pictures of our 4 year old daughter on the internet. First of all she does have some special needs issues and isn't really right in the head.. :)

Time and time again I see her post pictures of our daughter on Yahoo profiles, MySpace, Facebook, and other internet websites. They are not offensive pictures, they are clean. In most circumstances I wouldn't care, but she freely gives too much personal information to whoever asks for it. She would give out her home address, phone number, and someone would comment on the picture and she gives out our personal information. I remind her time and time again I wish to not have any pictures posted in the internet. But every few months I eventually find one.

Do I have a right as a parent to demand those pictures be taken off the internet? What legal rights do I have to demand they be deleted? I should at least have some rights.. Are any laws being broken? I assume if the pictures were taken by us, they are rightfully ours.. I am not interested in legal action.. I just want to have a talk with her and tell her this isn't right. :)

Simply tell her that you do not want pictures of your daughter posted on the internet, in as neutral a way as possible. Also, don't give her any more pictures.

We have discussed this with her 4 times in the last 3 years. Talking to her does no good. The pictures the last few times were taken either by her or other family members.

It might be a trivial or minor issue.. And I won't make a Federal Case out of it.. I would rather not have pictures of our children posted on the net. As a parent do I have a right to contact places like Yahoo, Facebook, or myspace and demand pictures to be removed?

sure you do, and they have the right to refuse.

Yes you can and most likely they will. My Space has this in there rules

8.14 includes a photograph or video of another person that you have posted without that person's consent;

If you go to the other one's and look at terms of service they will have similar rules.

Although if OP took the pictures herself, couldn't she use DMCA to attempt to have them removed?
she can attempt legally in a number of ways to have them removed.

She can spend thousands and thousands of dollars,

she can go to the website and hope for their cooperation.

Or she can approach her family member in a civilized and adult manner and insist that her child's pictures be removed.

I personally would shoot for the thousands and thousands of dollars......grin....NOT.
