Hi I like to know if some one is USA Citizen can she get divorce in USA.how whould she do that.

My Girl friend got married in India about three years ago she is USA citizen after marring to him found out he just got married to her to come USA she also found out that he has been USA before and got deported from USA so she came back and did nothing so far now we are thinking to get married so like to know how whould she get divoce to him from USA please help if any one know any thing about it .

She's going to need a divorce attorney to handle this. Is he still in the US? Does she know where to serve him papers?

Keep in mind that she IS a married woman whether she thinks the marriage was a fraud or not. In some states, her committing adultery with you could have an impact on how the divorce plays out. It's really not a great idea to be involved with a married person, so your best bet is to lay low and not talk about marriage (at least publicly) until she is divorced.

I agree, however she CAN get divorced in the US. She will need an attorney.

She would need to realize that she would have to serve him. He would have the right to dispute jurisdiction. She could get a divorce but she will not get any of his property -- marital or not -- and would only get her freedom UNLESS he chose to fight it and dispute it at which point she is looking at an Indian divorce. In other words -- she should get an attorney.

He is in India and because off deportation he can not come here even for the court.

He Does no wants divorce

No her husband does not want a divorce he is forcing her to sponsor her so he can come here in USA but she does not wants to do that.
