How do I get my boys back?

My wife left me and my 2 boys 2 years ago and moved to another state. This year we agreed she could have them the last half of the summer and bring them back before school started. Now she informs me that she intends to keep them for the whole school year. She says they told her they wanted to stay. They are ages 9 & 11. We do not have any legal separation or divorce yet. Is there anything that I can do immediately (besides getting the divorce) to get them back from Nevada? I live in New Mexico.What is the name of your state (only U.S. law)?

from what you state, you and your boys are legal residents of New Mexico. you need to file for divorce/custody/support/visitation. you will also need ot file for temporary order to have the children brought back. you need to do so immediately. please talk to an attorney.

I agree with IsabellaSoriano....

You need to do as Isabella says yesterday.... School starts in just a few weeks and you want your children back here before that.

Every day that you procrastinate gives their mother more standing.

Went through similar situation

I live in nebraska but my husband who rarely sees my two boys asked to see them and then informed me he was not bringing them back. I spoke with an attorney and was told to file a protective order which was the fastest way to be awarded temporary custody. Then would have to file for full custody and divorce and go through that whole thing. I would consult with a lawyer if at all possible and potenially look into filing a protective order not sure about your state but it worked for me. I received 90 days temporary custody and got my boys as soon as he was served.

PM = private message... look at the list of forums in the pull down menu box down on the right side... you will see 'private message'. You can go there, turn on your private messaging and send me as message.
