Debt Collectors - Sunday Telephone Calls

What is the name of your state (only U.S. law)? New York (NY)

Can collection agencies telephone on Sundays regarding debt collections. There is a company called RPM that keeps calling daily regarding a debt to Verizon, the telephone company. This is a new telephone number for us and we do not have service with Verizon. The RPM company claims that they were given our telephone number regarding another telephone matter (an unrelated telephone number.)

The requested to remove our telephone number are granted, but they always begin calling again the following month. This practice has been going on now for three months. What, if anything, can be done to stop the telephone calls? Why are debt collectors allowed to called on Sundays? Is this a new practice?

They can call any day of the week and they do not have to "remove your phone number". They are not telemarketers, they are trying to collect a debt that you do not deny owing. You can send them a letter to cease and desist all contact, but that will only make them sell it to another agency, or sue you.

Then you need to send them a letter demanding they cease and desist all communications, as you have no knowledge of any debt owed to Verizon by any member of your household.

I would write a letter to the collection agency telling them to cease and desist on all phone calls.

If they are calling everyday, and you are answering the phone, next time they call, tell them they are calling the wrong person, demand their address as you are going to send them written communication about the debt, get as much information (names, phone numbers, etc.) as you can about the debt and then (and make this the LAST thing you mention) remind them that according to New York Fair Debt Collection Practices they are "prohibited from calling you more than two times in any seven day period".

Once you've gotten all this information, tell them you will be sending a cease and desist letter... and politely hang up. (even if the collector is still talking).

You cannot cease and desist someone else's collection.

If they are calling for someone else, try politely asking for a supervisor and explaining that you are not the person they seek.

Yes, they are the same person. Mirk made a second account so it would look like someone was agreeing with him in the LL/tenant forum. He didn't fool anyone though.
