What is the name of your state (only U.S. law)? California

My question is what is the current Child Support Law for California. Brief Summary

I was promoted (04/18/2008), pay rate changed due to promotion. Company did not send wage assignment, received notice of suspension of driver' license (07/14/2008), walked missed payments to Child Support Office (07/16/2008), License suspended (07/24/2008) will not re-instate license (08/06/2008) terminated from job due to no current Drivers License.

This happens to me when ever I change a job or have change in pay rate. This situation occurs about every three to four years and I need to stop this viscous cycle. If you need more in depth details I will be glad to provide them. :mad:

Sorry, I'm not buying this story and I think I know CA's Child Support system better than most on this board.

A pay raise does NOT cause your license to be suspended. If your license is suspended, it's because you missed the payments, not because you got a promotion and a raise. If this happens everytime you change a job, then common sense would tell you to make the monthly payments ON TIME until the wage assignment catches up to you, which could take up to 3 months. Now, please go on ahead and tell me how many payments and how much you were in arrears when your license got suspended? How long was it while you were "between jobs" and you weren't paying your court ordered support? A change in jobs doesn't mean an automatic change in the child support amount. A modification has to be done. So, knowing all of that, in retrospect, is this CSSD's fault or your own?

That was just a summary. So to answer your questions

1. if you noted the dates it was 04/18/2008 that the pay rate change.

2. It would have been approximately 3 months 04/18/2008 to 07/14/2008 that the payments were not sent.

3. The wage assignment was removed from my check but the finance department did not send to CS.

4. Payroll department issued me a check on 07/15/2008 and I walked the check to the CS Office myself.

Additional information

This is NOT Court Order it is Voluntary Wage Assignment

I was NOT "between Jobs" same employer, promote to different Department and Pay Code

Had no reason to believe I was behind in CS. Wage assignment was being deducted from pay.

CS didn't notify me that there was any missing payments.

And I am aware the it takes 3 months for wage assignment or changes to catch up. I have been caught in the loop before.

I have canceled checks and letters to provide for verification of the described events

Are you saying that your employer deducted the money from your paycheck, but they failed to forward it to CSE?

Or

Did you not have deductions from your paycheck? If this scenario, you are responsible for forwarding what should have been deducted until they start deducting.

If you noted, I said a pay rate change has NOTHING to do with the existing order.

That is unacceptable.

Why is that? A payroll deduction remains a payroll deduction, even if you get a raise or a promotion. A monthly statement is sent out, did you read it? A quarterly statement is generally sent out... did you read it? Every county in CA has an automated service... do you call it periodically to make sure everything is ok? I didn't think so.

Good. Then they will release your license. I should note once again, and this time I will bold it so you see it better: NONE OF THIS WAS CSSD'S FAULT.

You keep saying you've been caught in the loop like someone keeps putting you in the loop. Why do you keep allowing yourself to get caught in the loop? Here are your words:

I guess you should know to pay your CS directly when you quit your job, get laid off or fired, and call occasionally to make sure the payments are being made.

Additionally, all of the counties are required to go online by the end of the year. Depending on what county you are in, their system may already be up. Los Angeles county is the last county scheduled to go online, and their deadline is in November.

My employer Deducted the amounts from my pay, but did not forward it to CS. The amount just collected in some account, they promptly issued me a check for that amount and I hand carried it to the CS office myself.

Now to answer your response.

2. The statements I have received DIDNOT indicated this error. I am glad to scan them in right now and let you see for yourself.

Okay CC, what is the penalty in California if an employer fails to forward the deduction?

I know what it is here in Florida.

Is there recourse for the OP since the employer was deducting the money, but not forwarding it?

Good, it's your responsibility to ensure YOUR CS is paid.

If they did not indicate there was an error, then how did the computer system catch that there was a delinquency and subsequently suspend your license? Protocol is generally 60 days no payments.

That is my point. I just need to know what happened or understand what happened so I may make a correction. I understand that it was more than 60 days, I am not blaming CS or anyone, I just need to stop this from happening, if it is something I can do good I will do it. You made a good point to check and make sure the payments are received and are received by the correct person. I rarely or never do that. Now I will do that each pay period.

Blunt is okay, the truth is okay. Sometimes even when we write the emotion that is in or minds can transgress to our writing, just like body language.
So to be absolutely clear

1. How do I correct My License. ( is there penalties that I have been charged that I need to pay?)

2. Are these penalties (if any and I think there are due to them not releasing my license) the responsibility of my employer or me ?

3. How do I find out what they are and what steps I need to take to resolve them?

There are civil penalties. I'll post the statute so the OP can see and utilize it for himself

5241. (a) An employer who willfully fails to withhold and forward
support pursuant to a currently valid assignment order entered and
served upon the employer pursuant to this chapter is liable to the
obligee for the amount of support not withheld, forwarded, or
otherwise paid to the obligee, including any interest thereon.
(b) If an employer withholds support as required by the assignment
order, the obligor shall not be held in contempt or subject to
criminal prosecution for nonpayment of the support that was withheld
by the employer but not received by the obligee. In addition, the
employer is liable to the obligee for any interest incurred as a
result of the employer's failure to timely forward the withheld
support pursuant to an assignment earnings order.
(c) In addition to any other penalty or liability provided by law,
willful failure by an employer to comply with an assignment order is
punishable as a contempt pursuant to Section 1218 of the Code of
Civil Procedure.
(d) If an employer withholds support, as required by the
assignment order, but fails to forward the support to the obligee,
the local child support agency shall take appropriate action to
collect the withheld sums from the employer. The child support
obligee or the local child support agency upon application may obtain
an order requiring payment of support by electronic transfer from
the employer's bank account if the employer has willfully failed to
comply with the assignment order or if the employer has failed to
comply with the assignment order on three separate occasions within a
12-month period. Where a court finds that an employer has willfully
failed to comply with the assignment order or has otherwise failed
to comply with the assignment order on three separate occasions
within a 12-month period, the court may impose a civil penalty, in
addition to any other penalty required by law, of up to 50 percent of
the support amount that has not been received by the obligee.
(e) To facilitate employer awareness, the local child support
agency shall make reasonable efforts to notify any employer subject
to an assignment order pursuant to this chapter of the electronic
fund transfer provision and enhanced penalties provided by this act.

(f) Notwithstanding any other provision of law, any penalty
payable pursuant to this subdivision shall be payable directly to the
obligee. The local child support agency shall not be required to
establish or collect this penalty on behalf of the obligee. The
penalty shall not be included when determining the income of the
obligee for the purpose of determining the eligibility of the obligee
for benefits payable pursuant to state supplemental income programs.
A court may issue the order requiring payment of support by
electronic transfer from the employer's bank account and impose the
penalty described in this subdivision, after notice and hearing.
This provision shall not be construed to expand or limit the duties
and obligations of the Labor Commissioner, as set forth in Section
200 and following of the Labor Code.


1218. (a) Upon the answer and evidence taken, the court or judge
shall determine whether the person proceeded against is guilty of the
contempt charged, and if it be adjudged that he or she is guilty of
the contempt, a fine may be imposed on him or her not exceeding one
thousand dollars ($1,000), payable to the court, or he or she may be
imprisoned not exceeding five days, or both. In addition, a person
who is subject to a court order as a party to the action, or any
agent of this person, who is adjudged guilty of contempt for
violating that court order may be ordered to pay to the party
initiating the contempt proceeding the reasonable attorney's fees and
costs incurred by this party in connection with the contempt
proceeding.

You said the license issue has already been rectified. Which is it? Has it or hasn't it? CSSD must issue an abstract, paperwork must come from Sacramento and you can take it down to the DMV to reinstate your license. If this is truly all the fault of your (previous) employer, then I would have them pay the reinstatement fees

Again, if the money was taken from your paycheck, but not forwarded, then it is the total responsibility of your employer and you should seek sanctions against them. Also, if your job is dependent on you having a license, and they fired you for not having a valid one, then I would bring that issue up to HR and (1) see if you can have your job back and (2) make sure they pay all penalties, including interest that you may have accrued (the code is posted above for your reference)
