My sister in law was awarded Full Custody of her 4 children today in court because of domestic violence. Based on testimony the judge issued a restraining order against the father.The father keeps calling the babysitter insisting that he can speak with his children whenever he wants but we are confused if indeed he needs the permission of the mother to speak with the kids. Can you please clarify if the mother is the one who has to give permission for the father to call and speak with the boys.

The RO was requested by the mother on Sunday and the mandatory hearing was two days later on Tuesday when the judge heard enough information to warrant a week extension of the RO for the Mother (a RO for the children was not discussed.) Next week the parents go back to court with more information regarding the fathers Domestic Violence at which time most likely the RO will be extended to one year. Next week as well the Custody of the children will be discussed.

And, as a side note, there is NO such thing as a "County definition of Full Custody" in Maryland. It's state guidelines all the way...

Was custody issued in criminal court as part of the RO proceedings? Or was this a Family Court Order? Is the RO temporary or for a year? Are the children included as protected parties in the RO??

If there is no restraining order regarding the children, then dad's communication with the children is not restricted. Full custody does not give the mother the right to refuse to allow the children and dad to communicate.

You, of course, don't have to always answer your phone, but you probably shouldn't totally prevent dad from communicating with the kids, while you have them.
