Is My College Violating My Rights As A Person With Mental Illness?

What is the name of your state (only U.S. law)? Pennsylvania

My college has been setting aside rules for me about as a person with mental illness what I can and can't do. This is following an incident in 2006 where I told a hospital that I wanted to go into the hospital because I wanted to kill a teacher. I know about the Duty to Warn clause. Here is the contract they gave me which as I can recall I wasn't in the right state of mind.

All I want to do is stop this contract from happening. I am currently on a forced year long medical leave from this institution.

My mom thinks I should sue but no lawyer would take my case (she even called 2 lawyers and they refused rudely to have this case.) I don't want to sue, I just want a cease and desist. Do I have a case? Do I need a lawyer for cease and desist?

I, personally, don't see anything there that's out of line, considering you threatened to kill a teacher. And if several lawyers have refused to represent you, that's a pretty good indication that you have no case.

Focus on getting better. That's a better plan than a lawsuit.

I don't want to sue anybody. I just want the contract to be stopped. I am not looking to get any money. I am at another college because they told me to get credits and it feels freeing that nobody is telling me what to do.I had others review the contract and they said it wasn't fair. If they really wanted me out of their college they would have let me graduate with my class instead of holding me back.

Would writing a letter to the administration and the person I "threatened to kill" not put me under this contract any more?

I don't want to transfer school I love my school but this issue is tiring. I just want it to end.

The college has the right to take reasonable steps to protect its stakeholders. Although I don't know for sure, let me suggest that the only reason the college didn't *expel* you for the threat was because of your mental illness. In other words, but for the contract, you would not be able to attend the school at all.

So, while there probably was discrimination, it was of benefit to you. If the contract were to be removed from you, perhaps you would be removed from the school.

Look, mentally ill or not, you admitted to wanting to murder your teacher. What about your teacher's right to a safe work environment? Your "rights" aren't the only one in play here. Your teacher's safety trumps your "right" to go wherever the hell you want on campus whenever the hell you want to.

No judge, unless ill himself, is going to say it's unreasonable for you to have to do things like go to therapy and avoid the teacher and his family and where his office is located.

If someone else without a mental illness had openly admitted to wanting to murder someone, that person would probably be witting in jail or in a mental ward. Be glad they're only telling you to go to therapy and avoid the teacher.

ok ok i understand. I was falsely put under the belief that my rights were violated. However I didn't approach the teacher to kill her but its still a situation that gives me the right to have a contract like that. With the Virgina Tech killings and Columbine I guess I shouldn't be complaining.

HOWEVER! The teacher didn't have it coming but she treated me so badly on more than one occasion that with my mental capacity I could have killed her but I did the right thing by going to the hospital so don't treat me like I was being the enemy by having thoughts of killing her.

I do want to make the environment safer for me and the teacher so does anybody have any idea how I should do it. I feel responsible for everything and the school even told me to have a conversation with the teacher to air out our differences. Should I go through with this? I think the school is being grateful by leaving me in the least I can do is work things out with this person.

Unless I can't read, what curse words were used?

If your teacher treated you badly you should have spoke to administration or your Dean. Your wishing to kill your teacher or even thoughts of it aren't fine just because you have a mental illness, there is never a good enough reason to want to cause harm to a figure like that.

I hope you continue to get the help you need before you end up hurting someone else, or yourself.
