Slip and Fall at Work

Hi:
Va and DC
A friend of mine slipped a wet floor of Lady's Room at work and hurt one of her arms. However, she didn't report the incident to her boss right away, thinking maybe 'only bruise.' She finally did report was one week later, seeing that a pain didn't go away and sought a medical treatment. Afterwards, she found a slippery floor of Lady's Room caused her injury. She started to blame, no Warning-sign, 'Wet Floor.' At first, she din't file any formal complaint against cleaning-co that providing Lady's Room cleaning. Now, she wants to file a formal complaint, ... even wanting to sue Cleaning.Co.

Wonder whether she's able to win the case like hers, ... Without a photo or any witnesses to prove her case? If there is a witness to this, she's only one to tell a whole story.:(

Win - highly doubtful.
How is she going to PROVE that she even fell where and when she says she fell? (It's a rhetorical question)

It's impossible to say since it depends on the evidence and whether the judge/jury believes her story. If she comes across as honest when she testifies, and she has circumstantial evidence to back her claim, then she certainly has a chance of winning. But she has a chance of losing as well.

HomeGuru is on to something. She would have to be able to prove damages to have an action against the at-fault party (which sounds like is NOT her employer). As for workers' compensation, it will not look favorable for her to not have reported her injury - but that does not necessarily bar her from workers' compensation benefits.

Out of curiousity, why are both states DC & VA named? Does she always work in one location? Is this the location where she was injured? Did she accept employment in the same state where she was injured? The jurisidiction of the claim will dictate the level of available benefits and the manner to which they are administered.
