Who is suppose to take the child back and forth to other parent???

What is the name of your state (only U.S. law)? FL

My ex husband has been picking up and taking his daughter back and forth for years now and once in a while he asks mom to deliver her to our house and she won't most of the time and when she does she is a real "b***h*. It isn't stated in the papers who is suppose to do what and I don't know if it is a law that they share delivery of child. I am proud that my husband does this for the sake of no arguement with the ex, but we are tired of "mom" calling the shots. What is the FL law in this situation?

FL law says that you have no say in the matter. Your husband doesn't seem to have a problem with it...

If his court order doesn't address transportation, then its up to your husband to provide it.
 
He asked me to ask you all. I wasn't making trouble for her, he was just wondering since the price of gas is so high that maybe she is suppose to be providing one way. I wasn't out to get his exwife, even though I said she can be a b***h sometimes, only speaking the truth.

Why is it the dads responsibility if it isn't stated in the papers. Not angry about it, just wondering what makes it dads respoinsiblity and not a shared issue.

Because its his visitation. Therefore if he wants to exercise it, he picks up the kids and returns them at the end.

At any point in the future if there is a modification I think that it would be reasonable for Dad to ask that the person gaining custody be responsible for transportation. Both parents have a responsibility to encourage visitation with the opposite parent. Many orders state that both parents take part in transportation. Having it with the parent gaining custody providing transportation often eliminates arguing about children not being dropped off on time, etc.

Looked this up briefly on the internet. Hopefully someone from Florida will come along with more information. I couldn't find a "wealth" of information, but I did find a few sites that addressed the situation.Looks like the responsibility for pick up and drop off may fall to the non residential parent, unless there is a change of circumstance. (If it is not specified in the order) So has the custodial parent moved since the order was written and created more distance for the NCP to exercise his visitation? Did the NCP move creating the distance? If there has been no change since the order was written (distance wise), then it may fall to your hubby to do pick up and drop off.

Perhaps Proud will come along. She's great at finding sites that address certain situations.
