What should I do???

What is the name of your state (only U.S. law)? IL

Don't know if this is the right place but I hope it is.

I moved in February of this year and was in an accident last May 07. There was no actual vehicle damage to either car (well mine had very minor bumper damage).

We exchanged information and went on our way. About a year later my insurance company sent me a letter stating I may received a summons letter.

Anyway, the person at my old residence called me and said a plain clothed officer from the Kane County Sheriffs department came to my old address and asked for me. They said that he had a huge packet of papers and was not able to tell them what it was for.

Anyway, the only thing I can think of is it's from this accident and I am now being served. I have had my mail forwarded to my new address since I moved but I am scared now.

Don't know what to expect. Should I contact the sheriffs office? Could I be issued a warrant? Don't know what to do.

The person at my old address said she gave them my cell phone number.

Alright, I guess I will call them and ask what is going on. There is about a 100 contact numbers for the Kane County Sheriff's office. Any idea which one to try?

Blueshirts: I need to speak to someone about a service of process in an automobile accident.

Operator: Okay, I'll ring that extension.
 
Well I contacted them and they said I am being sued by the party that was involved in the accident of almost a year and a half a go (may 2007).

I gave them my new address and they said I would be served in Fox Lake. Called my Insurance company and they just told me to fax the papers once received.

What BS this is...... the lady in the passenger seat got out as she was talking on her cell phone. We all agreed that there was no damage and we exchanged info and went on our way. Now this BS is coming up.

I know my insurance company will provide the attorney but I still think it's BS that after all this time this is coming up. Free SPA days for everyone.

You have no idea what she felt like when she woke up the next morning or what she's been doing for the past year. You don't know what her medical bills are or even what she is asking for. Though uncommon, it IS possible to receive a serious injury in a low speed accident. It may or may not be BS, they may just be filing to preserve the statute of limitations because treatment is taking a long time. This is why you have insurance. You screwed up and hit her, so this is what you have to deal with. But it's nothing worth complaining about at this time.

I don't buy it for a second. She got out of the car, her husband agreed there was no damage and we were going to go on our way. Then she chimed in and said well we should exchange information just in case something is wrong.

We were stopped at a stop light and I let off the brake "rolling" into their bumper. Ok, well maybe something was wrong with her neck but at a rolling speed < 2 mph.... I don't see how this is justified considering no vehicle damage.

I feel like I'm being taken advantage of and she / he / they are trying to get free spa / massage therapy out of it.

That's why you should ALWAYS get a police report.

A police report would make no difference. The lesson you need to learn is not to make assumptions when you don't know all the facts. Like I said, you don't even know what they're asking for, so how can you know it's unreasonable? Most soft tissue injuries don't manifest until a day or 2 after the accident, so her being fine at the scene doesn't mean anything. Let your insurance company handle things and don't worry about it.

Alright! I will wait to get the papers in Fox Lake (current residence) and fax to Insurance company.
