What is the name of your state (only U.S. law)? Virginia

My father died last Nov. with no will in place. My step-mother died 2 weeks later. He had an AIG Annuity with step mother as Primary beneficiary and myself and 2 brothers as Contigent Ben...Step- mother never claimed annuity. Admin of her estate(her family) submitted claim form and got annuity closed out. The way we see it (according to what I've read), if Primary is deceased, the contingents are paid first. If they aren't living, it goes to the PRimary's estate. Should we get the money or step-mother's estate?? :confused:What do you think??
