Fell off Mother's House Roof (Need Ins. Help)

Mother called me to come help my brother get a tree off her house that feel during storm. I accidentaly fell off roof while trying to help. Now have lots of unpaid medical bills, lost income and need opperation. Her homeowners policy agrees to pay 1000. (Max policy no-fault medical) But no liability because of No-Neglegence)
This will not put a dent in the damages so far or in the future.

Please advise

Should my mother's homeowners policy be responsible for all my losses. Not just the 1000 Medical payment section. Being I was trying to help secure the property from further damages the Insurance Co was responsible fore.
They stated that the liability portion of the homeowners policy would kick in and pay the remaining balances if their was negelence. But it was just an accident.

Ah, gotcha. I haven't read the policy, but it's probably a fair assumption that if the max limit on the no-fault coverage is $1000, that's all they'll pay. The insurance company is not obligated to provide any coverage in excess of what was paid for (in the premium).

So - the magic question: what's the policy actually say?

It sounds accurate. Your mother wasn't negligent. If she was negligent, then her insuance company would pay more. Since she wasn't negligent, she wasn't liable, so her liability insurance won't pay. But, your health insuance should pay. By the way, the insurance company wasn't "responsible" for further damage. It is the duty of the insured to mitigate the losses. Instead of paying a professional, you and your brother decided that you could do the job. That isn't her fault, nor is it the insurance company's fault. Just because you were on her property, she isn't automatically liale for the actions of an adult.

I was thinking along those same lines with one exception.
This happened on a Sunday Morning. Could not get in touch with a live person at insurance company with numbers supplied by them and in phone book.
Being as that my mother called me and requested me to come over and help, I thought that might be a grey area to open up the door for liability coverage.

No, not even close. The insurance company doesn't do any work. Had they answered the phone, they still wouldn't have done any work. All they do is pay the claim. By the way, most insurance companies have 24-hour claims service. Not necessarily 24 customer service, but claims service.

In any case, your mother had the option of hiring professionals or asking her sons to help. She chose the latter.

Also, I NEVER recommend $1000 med pay, your situation is one of the reasons why. It is never enough.
