Whether Billy Bob in the backwoods of some county and state still in the 17th century would do the same, I can't say. Since you are asking what *I* would do, that's it. And it's what the officer SHOULD do, and what most every officer would do.

I don't know how many ways to say this, but if there is no articulable suspicion to detain you for further investigation, you're on your way.

I read the police report where the police said that she was cooperative w/ each of the things he asked her to do (got out of the car, produced info., breathalyzer). She had her preliminary yesterday and they are actually dropping the speeding charges (huh?) but are holding onto the DUI and she'll be going to court later this month.

Her probation officer said things do not look very good, but did not specify anything in regards to what she thinks her sentence may be if found guilty. I'm preparing myself to hear jail...it's telling my mom (her g'mother) who is very close in local and emotions that I'm worried about. Anyone have any ideas of how much she could be looking at? Her dad (we're divorced - he remarried) was recently diagnosed w/ lung cancer and hoped to take her to disney for Christmas....he has no idea what's going on though.
I am not saying she will get jail time or not, as I have no clue on that. But, if she does get jail time, while it may be hard to see your Daughter or for grandma to see her granddaughter going through something like that it may be the kick she needs. If she truly does have a problem with drinking she isn't going to realize it until she hits her own rock bottom and sees the consequences of her actions.

I really hope she does realize it soon before it takes a Fatal accident for her to realize it.
