A male minor has written a graphic sexual note about another female student in class. Another student sees the note and laughs while looking at the female student. The writer of the note throws the note in the trashcan, never having given the note to the female student. The female student goes to the trash can, retrieves the note, reports it to the teacher as sexual harassment.

The male student is given Out of school suspension based on sexual harassment.

Based on the fact that the male student never directly gave the note to the female student, should this be deemed as sexual harassment?
