What is the name of your state (only U.S. law)? ILL. Married in MO. Long story short my wife and I can't get along. We've tried consuling and she starts a fight with me as soon as we get home. She has left without stating where she was going or calling for a weekend. I have factual proof she has had a non sexual relationship with another man. As of yesterday, she was supposed to come home after a work event but got drunk and blamed me for being mean so she stayed in a hotel. She has decided to take some of her things and leave for a undisclosed period of time. I'm done with her bipolar actions and need to know how F'ed I'm going to get. No kids. Both are names are on the house but I put all the money down (can prove it) pre marriage. I bought 99% of inside house items pre-marriage. We both have 401k's(mine has 10x more), a few life insurance policies and savings. What are my rights? What can I do to protect myself? How should I start the process? The equity in the house and the contents (unless you have premarital assets included in the contents) are joint property and will be divided equally. Unfortunately it doesn't matter that you put the down payment on the house premaritally, her name is on the house and its 1/2 her property.

The amount of money in your respective 401ks that accrued during the marriage will also be divided equally.

Any other asset or debt that accrued during the marriage will be divided equally as well.

One thing that you can do for yourself is to start coming up with accurate figures regarding assets/debts that accrued during the marriage, and an accurate valuation of your home. I wouldn't get too excited about valuing the contents of the home unless you have particularly valuable things...basically contents are valued at garage sale type values, and you are going to pretty much be expected to divide contents equally.
