Today I purchased tickets online. I paid with my credit card that had enought credit to pay for 2 tickets and more. Later on got a call from the agency (travel website) saying that charge was declined. So I called my credit card and was told that the agency tried to charge me twice the same amount and second charge was declined. But the first charge went through and was posted to my account. The tickets are non-refundable.

I called back the travel agency and got them on the phone with the credit card and while credit card representative was listening on the line I requested the agency to cancel my booking and return the money. The agent screamed that she will cancel my transaction and hung up. Credit card people told me that they have to wait 2-3 days and then charge will be removed, and if it will not, I can file a claim. The agent told me that they could not process the charge without confirmation number, so is it possible for me to take legal action if they claim not to receive the money while money was still taken from my card. Is there anything I can do?

Thank you for your fast answer. So there is nothing travel web site can do to stop me from cancelling my transaction at this point? On the website it said tickets are non-refundable and non-transferable...

Of course there is. They can challenge your dispute and reinstate the charge. You then get to argue that "The agent screamed that she will cancel my transaction and hung up." The credit card company will decide whether you have to pay or not. Shouldn't be a problem since you claim the credit card agent heard them say that (and would have notated your account with same).
