Refunded without paying

I think it will be easier just to explain what happened,

about 2 months ago i ordered something online with the cost of $250
the company never took the money or charged it on my card.
they sent the item and it arrived broken, we reported that to them
still not charged for 250 they refunded us back $250
so we ended up with 250+ out of the whole thing, we didn't use the money, we wanted them to contact us, now they're asking for the money back 2 months later.

what i want to know is, do i really have to pay them back? we never told them we needed the refund, they made the mistake.

they're wanting the money by next friday or they're going to set a court date.

i know this may be obvious that we have to give the money back, but why when it was there mistake.

most likely i'll just pay them back, i just want someones opinion who has more knowledge of the law than i.

well as long as i didn't make the mistake, i guess i wanted to be cheap because of there disgraceful packaging, man was that bad.

im going to pay it back, i knew they were gonna see there mistake sometime, just not 2 months later.

im actually lucky, i got the other stuff in the package that didn't break, not much but its something.

Hey, if you accidentally gave me a $100-bill instead of a $10-bill to take care of your $10-tab at a cash register, should I get to keep the extra money because you made a mistake?

you could keep it could you not? i hand you a $100 bill its out of my hands, of course your boss would make you give it back.

and your example doesn't include a 2 month delay, and now when i told them i want an email with all the information they say "i will send it within 2 hours" well guess what? that was 5 days ago.. no email.

stupid people make me agitated, and especially when she says shes the lawyer and wants the money by Friday (2 more days) shouldnt she be doing her job.

It's pretty clear you're looking for a way to keep the items plus the "refund." It's the same concept.

Look, you owe the money. You have the item plus are $500 on the plus side for it (the $250 you didn't pay plus an additional $250). Send the item back and give them back the $250, or give them back the $250 plus the $250 for the item you're keeping.
