What is the name of your state (only U.S. law)? Alaska
My boyfriend/partner informed me this morning that he consulted a lawyer. We will be meeting with him later today. I'm concerned about what this means to me.
Apparantly the lawyer said we live together and that the equity in my house could be a t risk. I dont feel this is accurate he also apparantly mentioned common law which I was under the impression did not apply in Alaska.
The house is in my name and all bills are seperate. He does not receive mail here or pay the bills. We file taxes seperate and he uses a different adress where his belongings are located at.
We have been together for 9 years and have 2 kids together. I've been trying to research Alaska banruptcy laws but am confused.
I asked him to set up meeting so i can speak with lawyer myself. i also informed him i will open a child support case if needed to protect myself. What steps can i take to protect myself and my assets. Thank you
p.s. be gentle my bills are current and i will not be filing

So, he wants to leave and you "threaten" him with an attempt at child support to protect yourself. Gotcha...
 
He doesnt want to leave he wants to file bankruptcy. I mentioned filing child support to ensure he contributes to the childrens support. I was wondering if child support had preference over unsecured debts

THIS makes it seem like you are attempting to defraud creditors. You live with him. He declares bankruptcy, but you want the child support to survive the bk action. So, he then pays you the CS and it ends up back in the household...

That may NOT be what you intended, but it sure looks that way.
 
My point is he does not live with me I pay all my own bills he rarely contributes to the household or the childrens upkeep. I pay the daycare i pay the dr bills. He contributes groceries and buys crap/toys etc for the kids that is all. He does spend most nights here but does not pay the bills. His clothes etc are in an overnight bag. He has items in bathroom and garage that is it. The house and cars are in my name i make the payments and pay the insurance out of my own money. The only things both are names are on are the childrens birth certificates and a harley i bought him for fathers day last year which i also make the paymenrs on.
I work six days a week as a waitress to pay my obligations and if need be will find a 2nd job. I don't approve of him taking this step and want to make sure my assets and childrens futres are protected

I do not live with him it is my house the lawyer is saying he lives with me. I do not feel this is true as he does not receive mail her and maintains residency at his mothers house.
