I am super super curious how the landlord "coerced" and "bait and switched" you.

Please provide details of this incident.

I'd like to see how such an intellegent person as yourself was decieved so blatantly!

Diva (If you really are), you quoted "Also, tricking people into contract is illegal, and if it is not, it should be." You just stated that tricking people is illegal but yet your not sure if it is. You just contradicted your entire statement. But it seems to me that your in denial because you do do not want to admit that you did not read over the lease before signing. If not, please explain how he tricked you into signing the contract? Gun or knife?

As well, you came to the forum to seek help. The members are trying to help yet you think they are your enemies? Did you come here to seek help on winning the case in court or argue with Zig if hes a landlord or not? Even if he was a landlord, more power to you. Its crucial to have different point of views but your not willing to accept them. If you are not willing to accept constructive feedback, then there is not point in asking for help. I agree with Alaska, this is a silly post. And no Diva, I'm not a landlord and yes...I do enjoy eating chopped broccoli. Cheers

ecmst12...I hear you, but what about the landlord's refusal to give me the vacancy lease rider or the receipts (as required by new york state law) to show me how the rent was calculated. I am not obligated to pay any rent that is not the legal rent. Also the last rent on record before mine was $730...he increased the rent $270. But he is only entitled to a 17% increase plus $25 on every $1000 for repairs. My calculations under new york dhcr laws: 17% ...puts my rent somewhere around $850. It is the landlord's responsibility to calculate the legal rent. I am not obligated to pay any illegal rent. Threfore the $1000 lease is again invalid. True or not?
I dont want to start trouble but where exactly does it state in law that you are not obligated to pay any rent that is not legal rent. Rent is rent in the eyes of the court. Rent is the agreed upon amount stipulated on YOUR signed lease.

Also, your calculations may not be valid. There is a lot to maintaining a house. Since you did not live in the apartment before you moved in, How do you know what the landlord did in repairs or improvements. For arguements, if the landlord ran new electrical lines to replace the old ones, do you know how much a licensed electrician charges for a job like this, or if a plumber ran new piping. The costs would start to add up pretty quickly.

I think at best you are assuming what your landlord did or did not do. Basically you need to pay him his rent and when your lease is up, move. You have the upper hand. Move when your lease is up.

The really funny thing about all this is that the OP may have a point. If she's (validly) living in a DHCR-governed unit, the LL has to follow certain rules which do not normally apply to residential leases. But she's so crazy that I gave up trying to find out is the LL is in the wrong. I'm sure the judge will be equally as thrilled with her demeanor.

But I guess a muscle relaxant and a little booze might do the trick.either way, Diva is in need of an attitude adjustment.

Diva has every damn right to be upset. She has a real chance in court if her landlord lied to her and she still has the newspaper showing the the amount he said he wanted. I went through a similar ordeal and I won my case of $2000 and the landlord had to pay all the attorney fees. After it was all said and done my landlord hated me and he lost his business because he was screwing a lot of people over so they all decided to start suing him.

I say get a hold of a lawyer and ask questions and maybe they will take the case pro bono.
