I live in a high rise condo, and over 30 units, including mine, were damaged when the owner of the penthouse let their bathtub overflow. Their insurance, Travelers, contracted some crooked company called GAB Robins, to handle the claims. GAB sent out a waiver they want me to sign and get notarized, releasing the insurance company and the owner of any future claims and forcing me to accept the dollar amount in the estimate for repair, with no right to seek more if the actual repair exceeds the estimate. This seems absurd and very shady,if not illegal, and I am very skeptical of any repair coming in at or under the estimate, especially since this is water damage, where the real damage may be hiding below the surface. Since when are insurance companies not required to pay the amount required to fix the problem, rather than trying to get me to sign a waiver which would prevent me from being compensated if they made a mistake. I have never had this problem with any car insurance company. I also dont see why I have to pay a notary to sign away any rights I could ever want. I am very concerned that I may have to file a lawsuit, perhaps even a class action lawsuit with all the affected homeowners, if the repairs are not made properly, but if I sign this waiver, I will not even be able to do that. All I really want is to get the damaged fixed properly, but the scam artists at GAB are raising a major red flag here.

I don't know of an insurance company which blindly passes out money. When you receive a check from the insurance company, they all require a written release. And if you use the notary at your bank, you don't have to pay a dime. In any case, if you feel their offer is too low, then contact the adjusters' boss, the insurance company directly, or your own insurance company.

Oh well, legal contracts mean nothing anymore, so I will just sign and hope all goes well. If I have problems I can always go after them in court. Insurance companies are almost as hated as lawyers, and rightfully so, so I will have no problem gaining sympathy from a jury.

This is how insurance companies operate. Get estimates. Then, you'll know if the check is for the right amount. The insurance company doesn't get the estimate for you. YOU get it for you.

Oh brother. Sue the insurance company. Yep, you'll have all the sympathy.:rolleyes:

I recommend getting an estimate for the water mitigation from a water mitgation company, then an estimate for the repair from a licenced contractor.

Or, you should have coverage under your policy for such a loss, so file a claim if you do not trust the other company.
