I have a few questions. How does a Judge in a change of custody case look at numerous counts of Purjury? Does a relocation restriction in the DD have any teeth in court? A little history- we have joint physical and legel custody. She is primary (during school year)with me having every (tue and thur evening for 3 or 4 hrs.) and everyother week-end and most of the summer. We do have the relocation restriction in the DD(50 mile radus) and now I get a letter that she is moving(1200 miles) out of state. I did get a restraining order and filed for change of custody. A little more insite.We have been divorced 4 years now. We just got out of court for the second time (1/08)to raise my CS (acomplished). Looks like we are going for round 3. She lives about 30 mile from me and I do all the transporting of the kids(6 years old) back and fourth. Due to her work her boyfriend who she has a baby with(and is still married to another woman) takes my kids to school every day and picks them up on the days that I dont have week-day visitation and he fed's and bath's them most days. I feel like another man is raising my kids. If a man is going to raise my kids it should be me. After the divorce she has moved 3 times and kids put in 2 differant schools. Texas will be anouter move and another school.She has never had any roots. I got out of the military to take care of my kids and now have a great job for 5 years and still live the the house the kids call home (stibility).Im am hoping the Judge will hear all the purjury and realize nothing she says is Credible. Has anyone here been in my shoes if so I would like advice or outcomes of your case. I go to court soon so any advice will help. Thanks!!!!

What perjury? She has been convicted of lying in court? Because if not then it is not perjury. It may have been what you consider lies but that doesn't mean it was perjury.

She has lied in her depositions many times and I have documents to prove it. No, she has not been convicted of purjury yet becouse we have not had your final hearing yet. Anymore advice or help please!!!!

Then make sure that you never remarry or have any other woman perform any of those tasks. because you, of course, wouldn't want another woman besides their mother raising your (joint) kids. ;)

I see your point. I would be happy to pick the kids up every day from school and keep them untill she gets off work. She want hear of it.

How involved are you with school activities/sports/etc?

How involved in the community are the children?

If you live 30 miles apart... would you be able to maintain the children's involvement in their HOME community (take them to the same schools, sporting events, etc)?

Is this a Military-related move?

1)She is moving for family support(her mom in TX). Her dad and step mom own a house in my sub-division and will be moving here in the near future.

2)Yes, me and my family are very involved with there school activities.
How involved in the community are the children?
3)She has moved 3 times in 4 years so they dont stay anywhere to long.

4)If I get custody they will not let the kids go to the same school. She has stated in her answer to my COC papers that she will be relocating after the final hearing.
Is this a Military-related move?

How old are the children? 6 years old.

Then there has been no perjury and you cannot rely on it. Prove your case as to why it is in the children's best interests to remain in your area with you and NOT move. Do not get sidetracked by so-called perjury (it is a very MINOR incident in domestic relations/family court). Concentrate on proving your case as to why it is in the children's best interests to remain with you.

I understand what you are saying I was only wanting to use the purjury toward her credibility. I think my Att. and I have a real good case(best intrest of the kids) without the purjury but every little bit helps. Thanks!!!!

If it is ACTUAL perjury -- things she has said under oath before that she is changing under oath now -- use it to get to her credibility. HOWEVER, don't make it the be all and end all of your case.

Thanks, will other things like my stibility,Job,great school system,extended family,and relocation restriction in the DD help me in the eyes of the court?

One can have all of that, but it comes down to the time spent and involvement the parent has with the child. You could live a school district that is under state watch & you can have a full-time job at the local gas station, but it's what you have with the children that is looked at. If you are involved with your children at school, activities, etc., the parent asking for the move has a huge burden to overcome compared to a parent that is not really there.

Me and my family are heavly involved with the children's school, activities, etc.
