X-Mas Visitation???

What is the name of your state (only U.S. law)? Georgia
My question is can my X leave the state with the kids if there is a RO(due to COC) in effect until the final hearing? I understand she wants to visit her mom in TX. with the kids for her visitation time during x-mas break. I am not trying to be a hard A$$ about this I am just asking the question. I would sign an agreement with her to go only if she would guarantee to have the kids back to me at the start of my x-mas visitation. She is already telling me that she is going to TX. and she will TRY to have the kids back in time for my visitation to start. What can I do if she does not have the kids back to me for the start of my visitation time? In the past she will call the day my visitation starts and say she missed her flight or they are stuck at the airport. Can someone help me out here because me and my family are holding off x-mas until the day my visitation starts. Thanks!!!!

Dont have it here with me right now. It does state the the kids can not leave the state of georgia until the final hearing. If I can remember my att. said that she may be able to visit family out of state. He also said it would look bad on me in the eyes of the judge if I gave her a hard time or tell her she can not go visit family on her visitation time. I dont mind her going I just want the kids back for the start of my visitation time. If she is not back on time what is the first thing I should do??? Thanks!!!!

Depending on the wording it most likely means the children cannot be MOVED out of the jurisdiction of the court. Taking the children on a short vacation is NOT moving them and hence would be permitted usually. HOWEVER it is important to know what the wording is exactly.

And if you have an attorney, ask him/her. If she is not back on time, you call her and find out what is going on. Were the roads closed? Airports closed? Flights cancelled?
Then you make decisions. Such as whether to file for contempt if she is purposely keeping the children from you. But we cannot guess. The first thing you should do is COMMUNICATE with the woman you had sex with. You need to be able to do that for the rest of your children's lives.

No. The first thing you should do is CALL HER and talk to your wife. Find out when the children are going to be back and state that you are missing your time per the court order.
