What is the name of your state (only U.S. law)? OR

My ex continues to harrass me by calling, but he attempts to "cover himself" by leaving messages he is calling to speak with our daughter. According to the parenting plan, he has 2 days every other week when he may call.
If he calls on other days, especially during the off week, etc., is he considered in contempt of court?
On the days he is allowed contact, I purposely have my little girl call him (30 minutes earlier) to try to aviod his calls/messages.

I've considered changing my phone number entirely, but he would only harrass my daughter (who is 7) to get it when he has her for visitation.

Wow. 2 whole days every OTHER week huh??

Unless there is some kind of RO preventing him from communicating with his child ...then no. He is not in contempt. But I can see a Judge chewing you out for not facilitating a relationship with child and father. How would you like to only speak to her 4 times a month???

phone calls and more

Baystategirl, my apologies, but you misundertand my point.

My ex husband has great visitation with our daughter. He gets her Wed night one week, then thurs-mon the next. He "works" as a photographer getting paid under the table so he claim as little as possible and avoid paying support. Meanwhile, he goes to my daughter's school for lunch 2-3 days a week. He also gave her a cell phone which she can use whenever she wishes to do so. I never ask to see it, nor attempt to restrict her access to it. (Ironically, when I gave her a Firefly phone two years ago for emergencies for visits with her dad, he kept the phone in his pocket and only let her use it once to call me during the entire time). On the other hand, I am only allowed to call her once during her weekend with her dad, and I don't do that because her dad lies in court and says I call screaming and cursing at him. He has scared, intimidated, and distracted my little girl enough over the last year to where she will not ask to call me even when she wants to do so. (This she shared with her counselor last year).

This is not about our daughter. This is about him being a batterer. There have been TRO's (2) in the past, which he was able to successfully violate with these same kind of calls, but unless there is a new (overt) threat, I cannot get another one. Meanwhile, I document and document the numerous driveby's my work, the calls, the 100+ emails. It is all about control. And while he will use an excuse and say he wants to speak with our daughter, he always leaves a taunting comment for me or some other little dig. This is just one form of attack I want to stop.
