What is the name of your state (only U.S. law)? Illinois

Hi all, haven't been on the boards in a while. Quick question for you:

If my ex & I were married for the majority of 2008, can we still file our 2008 taxes as married? It would be easier to keep things together this year and then move to separate filing for 2009. We're both in agreement that we'd like to do this, but we weren't sure if we could do that or not.

Does anyone know? The irs.gov site isn't very helpful.

Drat! We were hoping we could keep everything together for 2008 and then "go our separate way" on paper in 2009.
