What is the name of your state (only U.S. law)? Missouri

I lost my job and did a deed-in-lieu with the understanding that the balance would be forgiven and I'd receive a 1099 to claim it as income (it was about $20K). I gave them my new address which I know they recorded as I received a 1098 for the interest a couple of weeks ago but no 1099. I even called them and asked if all their tax paperwork had been processed. They said it, indeed, had been and they knew they were talking to me, as they had my loan # and new address. I was told my 1098 had been mailed. My question is, if I haven't received a 1099 from them by say mid February am I safe to assume, they didn't file one for me? I don't want to get in trouble with the IRS but I don't want to open a can of worms, either.

It may be that you will receive one for 2009 instead of 2008. If you haven't received it by mid february you probably will not receive one for 2008.
