What is the name of your state (only U.S. law)? Florida
I have a question about the college my wife attended. She went to nursing school and had 4 final payments before she could receive her diploma. 5 days before she graduated she went in to make the final payment w/ her credit card and following that transaction she "cleared" the different departments.
She cleared all, to include the finance department and then received her diploma. The school called us today and said the last payment on 10/20/08 never went through due to a glitch in their system and in fact, no payment from any student that day went through. The school said they realized this at the end of the year when they went over their books.
Now, my wife doesn't have a receipt from that payment and it's not showing up on our credit card statement from that timeframe. After speaking w/ my bank they said even though they can't find that transaction either, if my wife was cleared and received her diploma, that we should fight it as it is school policy to not receive your diploma until the balance is paid in full and this is an oversight on their part.
Again, my wife does not have that receipt from that transaction but is in the process of getting the packet saying she is cleared from the school and I was wondering if having that paperwork and the fact that school won't release a diploma until payment is made is worth getting a lawyer.
I typically wouldn't bother going through all this but we have had many problems with this school and their business practice over the course of the year my wife was there. We thought we were done with this school and now they come back with this. Serious responses with any advice would be highly appreciated.
Thanks,
Chris
