What is the name of your state (only U.S. law)? South carolina

Can unemployment compensation be offset in South Carolina?
I am in South Carolina. I opened an account with a bank (BB&T). On 2/10/2009, I made my first deposit in the form of an unemployment compensation check. On 2/11/09 they debited all of it from my account without warning. On 2/13/09, my utility check bounced, costing an additional $35.

I contacted them and they claim they "offset" my account based on a previous debt I had owed to them - which they had charged off years ago.

Is a creditor allowed to take my public entitlements (unemployment compensation) like this?

2 years ago I took my car to a mechanic for repairs. It cost me over $300. The worked failed a week later ( had to have it redone). The mechanic would not give me a refund. I did a charge back and then 3 months later, BB&T removed money from my account without warning causing me to go into negative. So I walked away from the accont.

Now, they take money from my account again without warning! They took $330 plus $70 in overdafts. Not to mention bouncing a check is a felony in SC which their actions caused me to do.

No please don't come on here talking about how high and moral you are and how I should just "pay my bills". This is just unethical.

Not everyone was born with a silver spoon! I am tired of working hard to only be robbed by big business in this coutry!

Okay, so you do not have a defense to owing this money.

In that case, the bank has the right to do what they did.

So, the bank has a "right" to take my money without warning, costing me hundreds of extra dollars in debt along with the $300 I threw away on the mechanic AND cause me to have a felony by bouncing a check? And why did they only take $330 when the debt is more? I suppose they can come along and take whatever amount they want at ANY time?

And what about the fact that they wrote off the debt years ago? So they get to have a take write-off AND collect the debt at the same time?

What a great society we have become. We should all just start walking around with our FICO score on our foreheads. Hopefully mine will be 666.

The next time someone shoots up everybody at a bank don't ask why.

Yes, remember you took their money first. You becoming a felon is your own fault.

Yes they most likely will.

Doesn't mean you still owe it, and yes they can come back and collect it later. It is called recovering a bad debt.

Unemployment isn't a public entitlement.

Unemployment is an insurance payment. Yes, they can take it. But you knew that because they did.

You spend a lot of time blaming others for your actions and problems. You should work on that.

They didn't take your unemployment money, specifically. What they took was money that was deposited into your account. They did not necessarily know nor care where it came from. And what gives them the right to do so is the terms and conditions that you agreed to when you opened the account. There doesn't need to be a specific statute allowing it because there is none prohibiting it, and YOU AGREED TO IT by opening the account. You may not have read all the fine print closely, but guess who's fault that is?

Debts don't go away just because no one is actively hounding you for them, or even because the SOL expires. They only go away when they are paid off.

The proper way to fight the mechanic was to take him to court, not to try to stiff your bank with your bill. Now, it's likely too late to sue him.
