I am wondering if the child disability benefits from SSI are credit againts child support order.?

SSI is sending my daughter 500 dollars a month as child disability benefits but the DCSE is not counting that as child support. I Cant work and still they are telling me that I havent paid child support in the past 3 months and are adding that amount of 250 to the arrears. what i need to do to get that money the ssi is sending my daughter to count for the DCSE child support.


please help me out.

SSI ( supplemental ) won't count .

If it came from your own disability , i would .

You can go to court and have your obligations modified , if you aren't working because of no fault of your own.

Get in there and file before more arrears are tacked on.

I agree with BL, if the child is receiving benefits because YOU are receiving benefits then get to court to get the orders modified so that the benefits count as your child support.

However, if the child is receiving benefits because the CHILD is disabled, that does not count as coming from you or being your share of the child's support.

LdiJ , I suggested the poster go file for modification , because he can not work .

And if he is disabled and can't work , he should apply for SSDI .

I suspect that he IS on SSDI and that is why the child is receiving benefits...however his post was very unclear.

i am recieving social security disability. They are sending the 500 dollars to my daughter as child disability benefits. How can i get the order modified? They told me I can only modified the order every 3 years.

I am in california and the child support case is in virginia how can i get to handle the order modification when i dont have money to flight to virginia?
