What is the name of your state (only U.S. law)? Oregon
I had a clogged toilet. There is one bathroom in the apartment. I called the landlord at 7:30 in the morning. He said he would get somebody to fix it. I wait and wait. I call the plumber he uses. He had not called the plumber so I get him to come. I called a couple of other places but the price was too high. Plumber comes at 2:30 or so and took care of it. It cost me $75. He said the landlord should replace the toilet. All this time no call from the landlord or his maintenance guy whom I also called at around 7:30am. At 5 pm the maintenance guy shows up and browbeats me for taking care of it and says I was not to do that. Was I supposed to use a bucket?
I am 57m diabetic and have a broken foot ( which I broke stepping into a hole by my car). This happened before and it took them 4 days to deal with it. I had to go sleep at my sons house for a couple of days because of it. i think that if they don't take care of it I shouldn't have to pay rent for the days I did not have use of the apartment or the bathroom. How to handle this?

It's not unusual to have to wait all day for it to be repaired .

While it's understandable one wants to use their toilet , stuff happens .

What if they had to spend all afternoon with replacing the toilet - the floor gaskets- etc . ?

You live with it the best you can .

There will be no compensation for non use of a few hrs .

Unless your LL is kind and reimburses you , the bill is on you .

The maintenance man did show up the same day .

Plumber is correct, however since you decided NOT TO wait for the LLs maintenance person, the cost is on you. LL COULD perform a plumbing inspection of the new toilet, which YOU would be liable for, to make sure the toilet was installed properly.

He is correct. That is why the LL has a maintenance person on board.

Was I supposed to use a bucket?
you're supposed to be an adult, so act like one...

boo hoo... there are many people with many problems...

You are entitled to NOTHING. You contacted the LL who issued a maintenance request, and had personnel respond within 24 hours which is ALL that is required from a LL.
As stated above, you should feel lucky the LL is not charging you a plumbing inspection fee for a toilet that was NOT approved.

Get over it...

more on toilet

No new toilet was installed, and I didn't say that it was. The plumber was the person that the LL calls anyway. The LL has refused to to get a new toilet last time the plumber told him this. The LL gave me a bottle of sulfuric acid to pour down the toilet. I don't have protective gear for that!

You don't need protective gear for sulfuric acid. All you need to do is pour it down the hatch. Though the landlord is an idiot for asking you to do so. Not only would it eat through the pipes, but you may hurt yourself or carelessly leave it where a child can get to it.

You should have waited or asked to use the neighbor's toilet...frankly, in 45 years in biz I have NEVER had the TOILET be the CAUSE OF THE BLOCKAGE....keep the toilet seat down when you are not using it AND be careful what you drop near it.....Life is hard and then you die. Landlords are NOT nannies, mommies or daddys!!

The subject line of the thread is clogged toilet, not toilet that needs to be replaced, or my landlord won't replace my toilet.

The internet contains many articles on how to unclog a toilet. In my opinion, the tenant should always try to take care of the problem themselves before contacting the landlord by simply trying a plunger.

Care, of course, has to be exercised on what goes down one. Even using too much bathroom tissue can cause problems.

As they say when you're forced to conserve water: Yellow is mellow. Brown, flush it down.

No - toiles do not BREAK * the flush mechanism often needs to be replaced and the seal at the base that sits on the herc ring may need to be replaced; however, the toilet itself does not have anything that breaks.

Older toilets (non-low flow) are at a PREMIUM as they are actually more water efficient as they only take 1 flush to work; whereas the newer/lo flow often use MORE water to flush the same amount of waste.

This is a new fangled toilet and the plumber said this particular toiler sucks. The flushing mechanism sucks. I fyou don't hold it down long emough it won't flush right not like the old ones that always worked when you flush them. I don't see the point of making distinctions between the parts of the toilet. If part of it doesn't work the whole thing is useless pretty much.

Then you don't know toilets .

I agree the newer toilets required to be installed when replaced , don't do as well flushing , but then again you had to know how it operated , and take the necessary flush or two when using it . Yes even a couple flushes or three if necessary when you are using it , not after .

Look up how they operate on How Stuff Works .

We have yet to hear how it was clogged .

Change tp brand...use Scotts w/Septic Safe on the wrapper

You don't get it...the problem is YOU HAVE THE NEWER LO-FLO TOILET and THAT is the problem; however, the GOOD ONES are no longer available...thanks to the "Left Coast" tree huggers, Gore zombies who think that we are using too much of the earth!!!

Jeeze Al, flushing 3X rather than 1X seems like a WASTE to me * can't help the pun...my bad.

Read instructions on how to change flapper. If flapper is not the problem, take a look at chain length and adjust.
