What is the name of your state? WA

My husband was sued for around $250 for a debt he owed to the real estate broker he worked for. He refused to pay it for one reason or another and then was, of course, sued and lost.

Am I liable for this debt as well?

They had me on the suit as Jane Doe and now they levied the bank account for the amount (which has grown, of course). All the money in the account is from my paycheck, not my husband's since he's out of a job currently.

Not hiding anything.....collection agency says they didn't know my name so they put me on the lawsuit as Jane Doe.

Bank account is in both names, yes, but I wasn't party to the debt. That's really what I'm asking. Are they really allowed to go after me on the suit for this debt?

Bang the drum....the deal is done:cool:

Joint account means that your hubby's debt is now paid. You can now move on with your lives minus the 250 bucks.

Regardless of whether it's paid in full now or not**************can someone please tell me if they really had the right to put me on the lawsuit even though I had nothing to do with the debt?

Yes they had a right to put on you the law suit. You also had the right to defend yourself.

yeah, unfortunately my husband can be an idiot and didn't tell me I was on the lawsuit. I found out after the fact when I answered a collection call. :mad:

Living in a community property state, they name you in the suit for the sole purpose of being able to collect on any of your joint assets. If they sue just him and get a judgement, they can't come after any asset that is jointly in your name. Therefore, they sue you both.

Whether or not you were included in the law suit has no bearing on the legality of them seizing the funds from your JOINT account.
