Okay, so he filled out the motions, filed and served her. She responded without using the proper forms. Is he supposed to respond to her response, or wait until court and address her response then? I asked that the other day and was told he should respond if there was something that needed responded to (and am not disregarding the advice), but would like a locals perspective.

I have never responded to a response. My attorney has never responded to a response. It really has both sides having stated their position on an issue, and now it goes the next step, which is the referee. Now, in that court form list exists a de novo motion if either party disagrees with the decision of the referee. Then it would go to the next level, aka judge.

But it's only because I'm very, very, very jealous. :p
The MI court website basically walks you through all of the normal stuff...it's very very nice (assuming you don't hit any bumps along the way). There are links to just about everything you could need access to.

Yeah, I saw that.

That's why I'm so damn jealous. My family court doesn't even have a website. At all. Let alone information and forms.

I have never responded to a response. My attorney has never responded to a response. So, really, he can just be prepared to address her response in front of the referree and not worry about filing yet another form...? That would be so much easier (he's more worried about not wording things the right way).
They haven't gone before the referree before, but hopefully it'll get worked out there. If not, he has an awesome judge. Very level headed and fair (and very oriented around the kids' best interest, not old school standards). She would make the right decision and my husband trusts that, even if he doesn't necessarily like it.

I'm jealous of California's system that even has a self-help place. My son is going thru stuff out there right now with the X GF and their child.

But, overall, I've not had much complaints about FOC. I've learned to put all my requests in writing, and I find their compliance wonderful. They also know WHO I'm dealing with - that helps.

Maybe you can start up a website where your state's residents can post forms and local resources...kind of a file sharing type thing :D I'm sure you have time for that, right ;)

Oh, his latest and greatest move: He is responsible for child's transport north; I pay coming back. I bought her return ticket back in December with an arrival time of 5pm - get home around 7 pm. He bought a round trip ticket with child arriving in far airport after midnight - we'll get home around 2:30 with that ticket. She gets to get up at 7:30 to go to school. Forget the part where I have to go to work in the AM too.

Needless to say, FOC put it in writing that it was an unreasonable plane ticket.

I am filing a motion to make ME responsible for getting the tickets and he reimburse me half.

I remember reading about that...he sounds like a piece of work. I'm assuming he's one of those that constantly pushes the limits just because...

Yeppers ... he didn't learn the last time he went to jail for not producing child.

How do I expect this to play out?

I sent my email to him asking if he would like for me to pick the 4:30 PM flight (arrive at 8:30) - home around 10:30. I gave a deadline of tomorrow.

What will happen is that he will continue to ignore me. I will put child on plane (has her missing half-day school on the way out.) He will ignore my ticket and put her on the unreasonable flight.

I will file the motion for show cause for contempt (not returning the child after end of Spring Break.) I am filing the Motion to change the transportation clause. I am going to have attorney request that he go to jail for a few weekends (don't want him to lose his job.) He was ordered to pay my attorney fees the last time (haven't seen the $$ yet.) Will ask for it again. Will also have the judge make the order on getting the $$ to start happening. Will probably ask for a bond to ensure future compliance.

It's too bad there's nothing you can do to prevent that kind of stuff...you know him well enough to know what he'll do, yet you have to wait for him to do it before you can even try to hold him accountable (which he apparently doesn't care about, anyway). And all the while, you're paying to do this and he still doesn't learn.

Husband's ex has been in contempt lots of times, but it's been nearly impossible for him to prove any of it and the attorney he did consult said it would never go anywhere...so, I guess the sneaky ones get away with the bad behavior. On the bright side, they've never had to go to court over anything until now :)
