So I do not have finicial statements. The bank account is in my wifes name and has been for years. Do I provide those or do I provide nothing cause it is not in my name?

What exactly were you asked to provide? Where does your paycheck go? Is it direct deposited? Or do you receive a check directly that you cash? Do you have a check book or debit card? Does your paperwork ask for your income AND your household's income?

1. 2008 Tax return papers ( this is the first year my wife and I have filed together and together we made 18,000 so I will be giving them my w2 also so they see I only made half of our income)

2. Finicial statements ( bank account is in my wifes name. I do not have a bank card my wife does)

3. Last three month paystubs ( I have not worked since Dec 08 and just got my first stub on the 15th of this month its a paper check I take and cash it a money box and give the cash to my wife she payed the kids daycare with it for this month)

I did put in the mail today a full months payment in the amount of $218.00 to the Attorney Generals office. So when my company starts taking out for the with holding I will always be ahead and by the time we go to court on the 7th I will be 1/2 payment ahead which I hope is a good thing.

Here is another guestion why is all this needed?

You do have financial statements. You have your paychecks. You have any bills that are in your name.

They will garnish any of your accounts or levy any of your property. And if your income goes into her bank account to pay the bills with YOUR name on it, then you need to include that bank account.

My name is not on the bank account it never has been. We have been married 2 years and she has never added me to the account. My wifes ex husband screwed her over when they were married and she does not want it to happen again. So it has always been that way. I can not get an account because of bad credit

I am not saying they would. I am saying they could if you do get behind.

How in the WORLD did you get almost a YEAR'S salary as a tax refund?

And how in the hell are you surviving on $18K a year w/two adults and multiple children? And how are you paying an attorney?

You do realize that 18K is roughly 8.65/hour FULL TIME? Do you see how impossible it is to believe that there are 2 adults working - even PART time - and the TOTAL income is that of ONE person making less than $9/hour?

They're asking for the financials because in nearly EVERY case that involves children, child support is looked at and reevaluated. It's gonna be REAL hard to justify being so far behind on CS when you received such an enormous tax refund, and it's gonna be real hard to justify not paying CS when you're clearly paying an attorney. And when they see your wife's bank account, you can believe they're going to go through it with a fine toothed comb to make damn sure you're not hiding the cash you've been working under the table for.
 
well CJ Jane lets start with mine and my wifes annual income came to 20,351 (9800.11 of that income was mine) so this is how it was broke down

$836.00 (fed income tax with held from w2)
$4817.00 (earned income for 2 children)
$1545.00 ( additional child credit)
$7500 ( first time home buyer credit $500.00 to be deducted for the next 15 years) Total $14,998 we toke the 7500 and put it towards a mobile home.

I am not paying for my attorney my Parents are. They are both doctors and believe I should have a right to see my daughter on a steady schedule. My wife also recieves child support for her children (which is 1152.32 that is my step childrens)but I can not use that because that is theres not mine. When I was behind in child support was because I was a full time student and going to school. Since then because of all the court dates and missing classes I was but on academic suspension. It toke me 3 months to find work and when I did find something it is not for the money I should be making. I toke the job so my child support could be with held and I did not have to worry about it being late. I HAVE NEVER WORKED UNDER THE TABLE you should not assume that....When I got my taxes I paid my child support current and up to date. I was going to pay three months ahead but was advised by my attorney not to do so because my ex would see dollar sighns and ome after me for more money. Which in this case is what she is doing. Both my parents make good money I was going to school to better myself so I could to also make good money and they knew that from the begining when I went to attorney general court. Thats why they based it on minimum wage but because of her petty BS it cost me my schooling and now I am only working for $7.50 an hour. I was advised by my attorney last night they can not get my wifes bank account and she sent it with her motion to dismiss. So apparently I do not have to worry about it now.

I hate to say C Jane you were realy quick to jump to conclusions and just think I was a dead beat dad. I am not that in any case. My child support was late but was always paid and I know I am not the only parent out there that pays child support late. Things happen and people get behind. That is not the case now. I am current as well as Aprils payment has been already made. I have talked to my employer they will be with holding 116.00 out of my check and mailing it on 3/28 so it is that it is at th AG by 4/1 then I will be paying ahead all the time.

Well it looks like my attorney is going after getting this dismissed due to the other attorney did not give all parties notice. ( She forgot to let the AG know) and the stuff she has asked for (2008 tax return, paystubs, finicial statements) she is circumventing the discovery rules requireing respondent to untimely appear with documents that should be subject of request for production giving respondent 30 days to respond my attorney also filed a answer to motion for enforcment for child support order and request for sanctions. she has told them that contrary to the allegatins of the motion for enforcment of child support order all amounts were paid by respondent to Movant. Exhibit A attached hereto was also attached to the motion to enforce child support order which clearly shows that the child support has been paid as well as to the date of this fileing he is ahead in payments. Contrary to the allegations of the motion of enforcment there are no arrerages Exhibit A clearly shows he is ahead by $222.32 and Aprils payments has been made. No arrerages have exhisted for at least a period of 30 days. my attorney is now going after her for sancations because the other attorney knowingly filed a case for enforcment when I was clearly ahead as well as she atached that as an exhbit showing I was ahead. My attorney is now calling it harrassment. I also found out she still has not completed her social study and is not scheduled to even start till April 26th. Me and my family did ours on Jan 24 3 weeks after it was ordered. It is still set for a finall hearing. I did not get any visits this month started the paper work for the exchanges and was told by Kidexchange in San Marcos if she does not do her paper work and pay fees there will be no visits.
 
Update on hearing

Well we had court on the 7th and it did not go to well. I was found in contempt of 6 child support payments that were late by 4 days. I was ordered to pay her attorney fees in the amount of $730.00 in 30 days. I was also put on probation for a year that if a payment was late I would go to jail for 30 days. However my ex got into no trouble for not doing the court ordered visits. So my visits now start all over again. So my payments are actually a month ahead now so there will never be any problems of not paying on time.

I know this is late but I just saw the bolded...this is potentially a VERY serious problem.

The first time homebuyer credit applies for a home that was ALREADY purchased (either at the time that the return was filed or the time that the return was amended) and is 10% of the purchase price of the home, up to 7500.00 for homes purchased in 2008 and 8000.00 for homes purchased in 2009.

Therefore, there is no way that a person could use the first time homebuyers credit to pay a down payment on a home, without committing tax fraud. On top of that, unless the home cost at least 75,000, you would not get a 7500.00 credit, you would only get 10% of the cost of the home.

It would have to be a darned fancy mobile home to cost 75,000.
