Just opened up FOC case...

What is the name of your state (only U.S. law)? MI

My husband just (last month) filed to reopen their case through FOC so that the CS payments he makes can be taken directly out of his paycheck every other week. Will his employer notify him when they start to do this so that he doesn't accidentally send out a check the same week that the garnishment starts? The FOC is doing an investigation to modify support at the moment...is it possible that they're going to wait until the investigation is over to start garnishing? Sorry if the questions are dumb, but he has no experience whatsoever with the Friend of the Court (obviously, neither do I)...

His employer might or might not notify him when garnishment begins. The best thing for him to do will be to make the payment AFTER he has recieved his paystub. If it wasn't garnished, he should send in the payment for that pay period. Then, when it does show up, he'll know not to send in the payment himself.

He shopuld speak to his FOC caseworker about when they will send the garnishment notice to his employer. I'm pretty sure that each CSE agency has thier own rules on this.

I rememeber that when my hubby filed for a modification in FL, he also notified the CSE about his new employer. They waited until after the modification to send the notice, while a friend of his had the same situation, and they sent his right away.

Thanks for the advice! He needs to get ahold of his caseworker, anyway, so that would be the best first step. Unfortunately, our county is swamped and it takes a long time to get calls returned and appointments set up. The child support kind of messed up as is...he has to submit payment directly to his ex-wife the day before his paycheck comes, so he'd technically be late if he waited to see if it was deducted or not. But, he's been a few days late more than a few times, depending on what day of the week it falls on (he just sends it in the kids overnight bag for their mom's house)...

I wish all this stuff was standard across the board...it would be so much easier for everybody to learn the rules of family court if it was the same everywhere
