by the judge for not having a lawyer with me today. i was not allowed to argue against my exs lawyer. [for 50 sentences of her trashing me i was only allowed about 5 [in comparison] the exs lawyer was using hearsay and false accusations to try and trash the first mediators report that was adopted months previously. [the mediator had said i did a good job in court] it just sucks judges dont give you any credability.

the second mediation report was very much against the ex as well who is on supervised visits. the mediation report goes on to say how [[the psych eval does not provide enough information to to make a decision reguarding mental health issues of concern and that more information is needed to fully form a diagnosis that can be trusted]]. the judge would not rule today that the ex needed a real evaluation and set that arguement for next week when i will have a lawyer.

i lost ground today because they gave the ex more hours of supervised visits and the judge ruled the first mediator must have made a mistake requiring the ex to do a 52 week parenting class bad thing is the second mediation report out today said that we should follow the first report in regards to parenting classes.

im dissillusioned with the whole proccess ATM

my lawyer is just saying that in 1 hour no resonable determanation can be made of any issues. that and the fact that no test were done. and no medical history was taken into account.

You got spanked because since you have a lawyer YOU can't be speaking for yourself. YOUR LAWYER has to.

I ran out of my retainer and now my lawyer is limited scope.

this was a money issue, i ran out and recently took out another loan.

If your lawyer did not receive permission to withdraw from the judge then he could not have withdrawn from your case. When did he become limited scope?

at the end of Jan i ran out of cash, [my last court hearing] she filed limited scope 10 days ago but 3 weeks ago she told me she would represent me on the main issues.

on a side not the judge did ask if i had the money to pay for ex,s psych eval but i dont have the money.


there was no issue that i was representing myself other then the judge went opposite of a mediation report that 3 other judges were fine with before her. and she went against the second report today that backed the first and raised questions about the mother.

the mediator who was present said the judge may have been trying to shorten up the whole proccess.

Are you trying to eliminate this parents visitation rights entirely?

on a side not the judge did ask if i had the money to pay for ex,s psych eval but i dont have the money.

For many reasons the courts often require such costs (which are pretty high) to be evenly split. If you cannot pay, it may deny your motion. Especially if, as the mediator suggested, the judge is trying to shorten up the process.

Judges can, and sometimes do, ignore psych evals and other reports.

im not trying to eliminate her rights, but she has proven to be a danger to the child and im worried about the mothers abilty to parent at this time.

mother was charged with 3 counts of child endangerment by the DA, the DA differed the charges in the event she takes her 12 intesive parenting classes.

the first mediator stated [she is highly concerned about the mother abilty to provide proper care] ordered 52 week parenting class and the psych eval. this was without the child endangerment charges. they were added after mediation.

My take on this is that perhaps the judge is doing you a favor. I think that perhaps the judge doesn't feel that you are competent to represent yourself and is more or less forcing you to get an attorney. I could be wrong, but that is what seems to be the case to me.

could be, i told her [judge] from the beginning that my lawyer would be answering to any custody questions next week so she knew i had council.

its just the fact that exs lawyer went off in areas she knew nothing about and was completly off base wrong about important aspects and i could not respond. [and the judge ruled that way]

this is the exs second lawyer who has not been through the whole case as a matter of fact it was her first day. the last court apperance was the exs lawyers partner i believe. 2 court dated before that she had no lawyer and 2 before that with her first lawyer.

i did get the exs lawyer stuttering when i hit her with the plain truth in the original rulings. it could have been allot worse for me and the baby as exs lawyer was arguing for overnight unsupervised visitation.

Well, the good news is if you can remember exactly how her attorney tried to trash you, you can take that back to your attorney so you know what to defend yourself around!

i dont wish this court stuff on anyone, this case would not have been that bad but the ex started it with false accusations of abuse to try and gain the upper hand in the custody battle.
