What is the name of your state (only U.S. law)? OHIO

I am hoping someone can point me in the right direction. I currently have an outstanding claim with my H/O insurance company for a collaspe of the roof of my garage. The detached garage is covered for 12,500. The claims adjustor is indicating that they will pay 10,800 (before ded.) towards removing the remaining roof and replacing it with a new roof. I am not particularly thrilled with this option. The garage is a two car garage built in 1930. It still has the rough non-finished floor with cement foundation footers only. The size and appeal of my back yard is limited by the location and size of the garage. I know that I could replace the 2 car garage with a 1 car newer garage for the 10,800 that is being offered. Is this within my rights or do I have to simply replace the existing roof?

Read your policy, but that should be fine.

Thanks for the reply! I have read my policy but dont know what details would determine if it is feasible. I am an insurance novice, could talk mortgages and finances all day but insurance escapes me. If my policy does indicate that I am within my rights to build a new garage, what occurs if my garage costs are less than the settlement? For example, if the garage I want to build costs 8000 but the settlement is for 10,800 (before deductible) or net 10,300 do I keep the remaining balance or does that go to the insurance company? When I inform the insurance adjustor of my wishes to build a new garage, Can it change the settlement, and if so How? I appreciate any advice you may have regarding reading the policy and my subsequent questions

Unless it is otherwise stated in your policy, you can take the money and do what you want with it!

Agree with the above but you also have to figure in the cost of removing the debris from the old 2 car garage if you choose that option. So I would start by getting quotes on removal and the new structure combined before you make a final decision. Debris removals can be pretty pricey and you may not have much of the $10,800 left to rebuild after paying for getting rid of the old structure.
