What is the name of your state (only U.S. law) TX?


Okay My hubby and I will be supeniaed (spelling sorry) about a CPS case. Basically CPS took the child away from a mother who I daycare for. Moms court appointed attorney is the one who will be doing this. My DH just lost his good job and is starting a new one making 10 a hour ... its a HUGE pay cute for us. This is temp until he finds another decent job. But until then we are VERY tight. DH has training for 2 weeks and can not miss any of it other wise he is no longer emplyed by them or he has to wait and train for the next class .... but who knows when that is and we need him to be working now.

As for me I will loose money for that day with all the kids I watch. We cant loose money right now. Its just the wrong time. Also my inlaws moved and I no longer have anyone to watch my children.

So what can we do?

you could ask to appear by phone,
you could hire a substitute day care provider for the portion of the day that you will be gone.
not sure on the timeline of dad's school vs. court case....but dad could help with the daycare/your own kids for while you are gone.
you should talk to the lawyer subpoenaing you and ask about time accommodations...he may be able to schedule you first thing in the morning or right after lunch or towards the end of the day- not in any way a guarantee but he might be able to try.

maybe your mother in law could come and visit for a day or two to help out....

The job cannot fire him or otherwise discipline him for answering a court order -- which is what a subpoena is.
 
Its not a CPS's behalf its on the mother who is being accused behalf. I understand about being their for a child but I have three to take care of and if I loose money or DH looses his new job then we can not support them.

I asked her to ask her attorney if we can write a letter or ohone conference but I havent heard back.

All she wants us to say is that we never saw her drunk/drugged up when she was dropping her child off with me. Which is 100% true.

here is THE thing!- you have a court order commanding your presence....quit finding all the ways it cannot work, and figure out how it can work....have your MIL come visit

I don't think her husband is named in the subpoena...it's her....but hubby cannot cover for her absence at the in home daycare because he has to work/train
 
here is THE thing!- you have a court order commanding your presence....quit finding all the ways it cannot work, and figure out how it can work....have your MIL come visit

I am not trying to find ways it wont work. This is my life. I dont have anyone to watch my kids. Thats why since I have had them (even when my MIL lived here) I have had 0 nights out with kids. My MIL doesnt do babysitting. Shes not that grandma. Even if she did she is over 10 hours away

call the local health and human services and ask for sitter referrals that are certified/licensed so you can start interviewing**************

then take the kids with you. it's frowned upon, but if you do NOT go, you can get a warrant for your arrest. i'd rather attend, they reschedule or work with me.
 
I always stand by the fact that if a child needs help you do it no matter what.



I got so sick and tired of people telling me my stepson was abused and neglected and specifics of it but then saying "we dont want to get involved"


I make a point no matter who it is, if a child is being mistreated I will be there.
I had the same problem. Dad's family tells me all the time that SM hits my son, but they refuse to tell CS or go to court to testify about it because they don't want to cause problems in the family. :confused:

Did you actually receive the subpeona yet? Did your husband?

Call her attorney, do NOT ask her to ask her attorney. YOU CALL THE ATTORNEY. Tell him you don't think you have anything to say that will help MOM'S case since YOU are the one that practically FORCED her to take the child to the ER to begin with. YOU should not be testifying FOR MOM. YOU should be testifying FOR CPS.

Also, YOU are not qualified to state whether Mom was 'dunk or drugged up' when dropping of the child. You are not a medical or substance abuse professional. Your testimony will NOT be helpful and I'm 99% sure the attorney has NO INTENTION of having you testify.
 
We have not received the supenia yet. I got a call from mom this morning and she left me a message letting me know. I have called her and texted her to explain the situation but I can not get ahold of her. How do I find out who her attorney is? It is a court appointed attorney.
