extended Summer possession for CP

I am the custodial parent. My x wife gets visits 1,3,5th. She has to give me written notice by April 1 of what dates she wants for her summer visits. She always does the default of July 1-31.

I get to choose one weekend during her 30 day visits in which I get my DD. This year I believe she is changing it to June. Since I get fathers day automatically will I also get my weekend I choose? So in that case I would get 2 weekends of her 30 day visit?

Based on what I know of the TX guidelines, no.

Why would you even want to do that? You get your own uninterrupted summer time under the TX guidelines so why would you want to ensure that she didn't get any?

To the caring father with the question, you can have father's day since it overrides visitation AND still get your weekend separately. It is the mother's fault for changing her month from July to June. If she didn't want to give you an extra weekend she should have stuck to July visitation.

Ldij, why did you respond like this? You said to let Mom have uninterrupted 4 weeks and OP let you know their order says the CP gets a weekend during Mom's 4 weeks. So why let him know you have no respect for him? Wouldn't it be more accurate to say you have no respect for his *court order*?

OP, do you have a standard order? There is a very specific reason I am asking.

Also have you talked to the other parent about this? What does the other parent say. Maybe if you just communicate about the court order the whole issue would be solved before there really ever is one.

Again, there is a specific reason for my question. If this is a standard possession order, the answer is very clearly spelled out in black and white.

I will say, however, from what he posted and assuming he has a standard possession order, YES, he is entitled to his one weekend IN ADDITION to Father's Day Weekend. Some may not like it or like Dad for the order, but that wasn't the question and he did NOT deserve a certain response for asking a legitimate question (a question who's answer is most probably supported by a very clearly written statute).

How many days did Mom ask for? Per standard order,if the period exceeds thirty days CP can have child for two non consecutive weekends. However notice must be given to the NCP by April 15 of these weekends. Father's day would not count as one of these weekends since CP gets Father's Day regardless. If the period does not exceed thirty days, CP gets one weekend if he gives notice by April 15.

Extended Summer Possession By CP

If CP gives NCP written notice by April 15 of a year or gives NCP fourteen days' written notice on or after April 16 of a year, CP may designate one weekend beginning no earlier than the day after the child's school is dismissed for the summer vacation and ending no later than seven days days before school resumes at the end of summer vacation, during which an otherwise scheduled weekend period of possession by NCP shall not take place in that year, provided that the weekend so designated does not interfere with NCP's period or periods of extended summer possession.
