What is the name of your state (only U.S. law)? OHIO

My wife and I separated a year ago because she cheated. We have two boys (3 and 5) I moved out for a while, and eventually, we agreed that I would pay her some child support (on our own, without courts knowledge) so she could make it on her own, and find her own place to live. We have not filed anything what so ever. She is about to move in with her boyfriend, and we both have our boys equal time. I have them Mondays, and Tuesdays, and every other Friday, Saturday, and Sunday. My question is....Do I have to pay child support, even if I make a little more money then her, if we have complete split custody? It just doesn’t seem fair, I have to support them half the time, and help her support them for her half as well??

In Ohio yes you will.

How "little" is a "little" more? Who is paying health insurance? Who is paying child care is any? When you say a "little" more, how big is the difference? A few hundred? A few thousand? How few?

Please, please, please, please, please, please, PLEASE reconsider.

You need to protect yourself and your rights (which would also perhaps protect hers - and protecting both of you legally can't be a bad thing, right?) with regards to custody and support. It doesn't necessarily have to be an adversarial process, but in all honesty any informal agreement can come back and bite you in the backside. Get it formalized through the courts.

Do it for all of your sakes...that way you'll both know what's been decided, and should things turn "less than friendly" - as they are wont to do in these situations - you'll have that court order to make sure neither of you tries to screw the other.

(I'm not for one second suggesting either of you would do such a heinous, selfish thing that's obviously not in the best interests of the kiddies..but it does happen)

Thank you all for the advice. I pay for health insurance, and we both pay for child care. who ever has the boys, is responsible for child care that day. She just got a new job, so now I make 6 more dollars an hour then her. She did get mad at me one day in the past, and went to file for child support. now things are better, and she is trying to stop that process since we are about to file for a dissolution any ways.
